		<section id="id46D1C13E01CB4A16BFE52A7B215548AD" section-type="section-one"><enum>1.</enum><header>Federal data
		center consolidation</header>
 <subsection id="id36BF1E6E4ABB41FF8D5C73C3519D52C2"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id20FE6E49CB684A6F9AAA33A1B83292AE"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator for the Office of E-Government and Information Technology within the Office of Management and Budget.</text>
				</paragraph><paragraph id="id72FC77F5A2A141659F7BFF01685FD175"><enum>(2)</enum><header>Data
		center</header>
 <subparagraph id="id77D3D12AEDB64E84A5DF087D20F387E2"><enum>(A)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <term>data center</term> means a closet, room, floor, or building for the storage, management, and dissemination of data and information, as defined by the Administrator in the <quote>Implementation Guidance for the Federal Data Center Consolidation Initiative</quote> memorandum, issued on March 19, 2012.</text>
					</subparagraph><subparagraph commented="no" id="id45A4A5CDB19F48ED88C0F199FCA7D5C3"><enum>(B)</enum><header>Authority to
 modify definition</header><text>The Administrator may promulgate guidance or other clarifications to modify the definition in subparagraph (A) in a manner consistent with this Act, as the Administrator determines necessary.</text>
					</subparagraph></paragraph></subsection><subsection id="idF0FD7BB056474E2CA7F6ABA618C8D14A"><enum>(b)</enum><header>Federal data
		center consolidation inventories and plans</header>
				<paragraph id="id1a1c31e6bf524f1db9b9668f136e0e05"><enum>(1)</enum><header>In
		general</header>
					<subparagraph id="idFE0FCA54052948F9AEEE27DCAF2C17BA"><enum>(A)</enum><header>Annual
 reports</header><text>Each year, beginning in fiscal year 2015 through the end of fiscal year 2019, the head of the agency that is described in subparagraph (E), assisted by the chief information officer of the agency, shall submit to the Administrator—</text>
 <clause id="id1389c80fb2ac4eef88cba098b1134089"><enum>(i)</enum><text>a comprehensive asset inventory of the data centers owned, operated, or maintained by or on behalf of the agency, even if the center is administered by a third party; and</text>
 </clause><clause id="id0db486d6c8f84b2ea77e0d6a55372fed"><enum>(ii)</enum><text>an updated consolidation plan that includes—</text>
 <subclause id="id41ead275ebdb4582a786edad54e4c7e2"><enum>(I)</enum><text>a technical roadmap and approach for achieving the agency’s targets for infrastructure utilization, energy efficiency (including performance benchmarks such as Power Utilization Effectiveness and use of Energy Star-rated equipment), cost savings and efficiency;</text>
 </subclause><subclause id="id50d4e2ab5f2849b9bbd9f1ee799a10ea"><enum>(II)</enum><text>a detailed timeline for implementation of the data center consolidation plan;</text>
 </subclause><subclause id="id290dea0753f74ce1bf5127f49cab459a"><enum>(III)</enum><text>quantitative utilization and efficiency goals for reducing assets, improving energy and efficiency, and improving use of information technology infrastructure;</text>
 </subclause><subclause id="id226a2d95316f42d9946524792a5bdbb9"><enum>(IV)</enum><text>performance metrics by which the progress of the agency toward data center consolidation goals can be measured, including metrics to track any gains in energy utilization as a result of this initiative;</text>
 </subclause><subclause id="id0c25af706f5747dbb9c5e5d7a8ef304a"><enum>(V)</enum><text>an aggregation of year-by-year investment and cost savings calculations for 5 years past the date of submission of the cost saving assessment, including a description of any initial costs for data center consolidation and life cycle cost savings;</text>
 </subclause><subclause id="idd9f79ec878214db7b68dce1f453285f8"><enum>(VI)</enum><text>quantitative progress towards previously stated goals including cost savings (including savings measured on a total cost of ownership basis) and increases in operational efficiencies and utilization; and</text>
 </subclause><subclause id="id5510ad00e3a14a2aae9d690a26a92b46"><enum>(VII)</enum><text>any additional information required by the Administrator.</text>
							</subclause></clause></subparagraph><subparagraph id="id512575BE848B48AC92D540A847A55481"><enum>(B)</enum><header>Use of existing
 reporting structures</header><text>The Administrator may require the agency described in subparagraph (E) to submit any information required to be submitted under this subsection through reporting structures in use as of the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="id9a388d8d58a54c5fa8c59d80111828bb"><enum>(C)</enum><header>Certification</header><text>Each year, beginning in fiscal year 2015 through the end of fiscal year 2019, the head of the agency, acting through the chief information officer of the agency, shall submit a statement to the Administrator certifying that the agency has complied with the requirements of this Act.</text>
					</subparagraph><subparagraph id="id985682E3643745969EFEA084E348606F"><enum>(D)</enum><header>Inspector
		general report</header>
						<clause id="id4AF7E396BEF048E2BE498687D1D45BAD"><enum>(i)</enum><header>In
 general</header><text>The Inspector General for the agency described in subparagraph (E) shall release a public report not later than 6 months after the date on which the agency releases the first updated asset inventory in fiscal year 2015 under subparagraph (A)(i), which shall evaluate the completeness of the inventory of the agency.</text>
						</clause><clause commented="no" id="id2d25274aa27e46a38daec7d7fc47cde4"><enum>(ii)</enum><header>Agency
 response</header><text>The head of the agency shall respond to the report completed by the Inspector General for the agency under clause (i), and complete any inventory identified by the Inspector General for the agency as incomplete, by the time the agency submits the required inventory update for fiscal year 2016.</text>
						</clause></subparagraph><subparagraph id="idF2CE99C2180B486F9561F97035DBCB3A"><enum>(E)</enum><header>Agency
 described</header><text>The agency described in this paragraph is the Department of Energy, including all agencies under the jurisdiction of the Department of Energy.</text>
					</subparagraph><subparagraph id="id6924B95F9AD04BB89E489DF79EC7EAF1"><enum>(F)</enum><header>Agency
 implementation of consolidation plans</header><text>The agency described in subparagraph (E), under the direction of the chief information officer of the agency shall—</text>
 <clause id="id79D203F78F3A4DF2A8C4C7F065C729A9"><enum>(i)</enum><text>implement the consolidation plan required under subparagraph (A)(ii); and</text>
 </clause><clause id="idBE2A8C76B14B42A988D4879CB56DE401"><enum>(ii)</enum><text>provide to the Administrator annual updates on implementation and cost savings (including life cycle costs) and efficiency improvements realized through such consolidation plan.</text>
						</clause></subparagraph></paragraph><paragraph id="idD6314C3238054D60B98060E3CD99084F"><enum>(2)</enum><header>Administrator
 responsibilities</header><text>The Administrator shall—</text> <subparagraph id="idC158D507ACD547B4843CBC2896083720"><enum>(A)</enum><text>establish the deadline, on an annual basis, for agencies to submit information under this section;</text>
 </subparagraph><subparagraph id="idDF79E1FA3739456F80F335001F2F7699"><enum>(B)</enum><text>ensure that each certification submitted under paragraph (1)(C) and each agency consolidation plan submitted under paragraph (1)(A)(ii) is made available in a timely manner to the general public;</text>
 </subparagraph><subparagraph id="id87d4c0bc747b407aa18269091156a740"><enum>(C)</enum><text>review the plans submitted under paragraph (1) to determine whether each plan is comprehensive and complete;</text>
 </subparagraph><subparagraph id="id3930bb3c78ca4234b18927b6d4570ab2"><enum>(D)</enum><text>monitor the implementation of the data center consolidation plan of the agency described in paragraph (1)(A)(ii); and</text>
 </subparagraph><subparagraph id="id9d49c2ba55be4e4b8a7892c1afeeccef"><enum>(E)</enum><text>update the cumulative cost savings projection on an annual basis as the savings are realized through the implementation of the agency plans.</text>
					</subparagraph></paragraph><paragraph id="id0D046FD6C1EA4DD9BDD7318EEED50A74"><enum>(3)</enum><header>Cost saving
		goal and updates for Congress</header>
					<subparagraph id="idab24fd25522948ab8ea52857cae176a1"><enum>(A)</enum><header>In
 general</header><text>Not later than 180 days after the date of enactment of this Act, or by September 30th of fiscal year 2015, whichever is later, the Administrator shall develop and publish a goal for the total amount of planned cost savings by the Federal Government through the Federal Data Center Consolidation Initiative during the 5-year period beginning on the date of enactment of this Act, which shall include a breakdown on a year-by-year basis of the projected savings.</text>
					</subparagraph><subparagraph id="id99580b624b4144dcb9b4eef2407db419"><enum>(B)</enum><header>Annual
		update</header>
						<clause id="id7FEAD86B63344E40812BC73A8E0325AB"><enum>(i)</enum><header>In
 general</header><text>Not later than 1 year after the date on which the goal described in subparagraph (A) is determined and each year thereafter until the end of 2019, the Administrator shall publish a report on the actual savings achieved through the Federal Data Center Consolidation Initiative as compared to the projected savings developed under subparagraph (A) (based on data collected from the agency under paragraph (1)).</text>
						</clause><clause id="id64DF21B58B8A46B0AE9935E07B76A08B"><enum>(ii)</enum><header>Update for
 Congress</header><text>The report required under subparagraph (A) shall be submitted to Congress and shall include an update on the progress made by the agency described in paragraph (1)(E) on—</text>
 <subclause id="id84dffe7c644d40c692599db1fc09a2be"><enum>(I)</enum><text>whether the agency has in fact submitted a comprehensive asset inventory;</text>
 </subclause><subclause id="id84d4e823ade1487b919284ab48c5e05b"><enum>(II)</enum><text>whether the agency has submitted a comprehensive consolidation plan with the key elements described in paragraph (1)(A)(ii); and</text>
 </subclause><subclause id="idc016f19345714e1cb938db1ce4f84ec9"><enum>(III)</enum><text>the progress, if any, of the agency on implementing the consolidation plan of the agency.</text>
							</subclause></clause><clause id="idB7A2B981EE2949109E91DA5FCF79CD08"><enum>(iii)</enum><header>Request for
 reports</header><text>Upon request from the Committee on Energy and Natural Resources of the Senate or the Committee on Energy and Commerce of the House of Representatives, the head of the agency described in paragraph (1)(E) or the Director of the Office of Management and Budget shall submit to the requesting committee any report or information submitted to the Office of Management and Budget for the purpose of preparing a report required under clause (i) or an updated progress report required under clause (ii).</text>
						</clause></subparagraph></paragraph><paragraph id="id383679C2584A433997240048DC23D52D"><enum>(4)</enum><header>GAO
 Review</header><text>The Comptroller General of the United States shall, on an annual basis, publish a report on—</text>
 <subparagraph id="id77aa4edf65a4445a9101a84407e0b659"><enum>(A)</enum><text>the quality and completeness of the agency’s asset inventory and consolidation plans required under paragraph (1)(A);</text>
 </subparagraph><subparagraph id="idee138ae6aa38445ca98644e12916b786"><enum>(B)</enum><text>the agency’s progress on implementation of the consolidation plans submitted under paragraph (1)(A);</text>
 </subparagraph><subparagraph id="id642c14a595d443d2b0923e444a9f803e"><enum>(C)</enum><text>overall planned and actual cost savings realized through implementation of the consolidation plans submitted under paragraph (1)(A);</text>
 </subparagraph><subparagraph id="id232ab94d04f448fe82d7806beb909e8c"><enum>(D)</enum><text>any steps that the Administrator could take to improve implementation of the data center consolidation initiative; and</text>
 </subparagraph><subparagraph id="idfb4ceb168eda4f908e0ef810873b888a"><enum>(E)</enum><text>any matters for Congressional consideration in order to improve or accelerate the implementation of the data center consolidation initiative.</text>
					</subparagraph></paragraph><paragraph id="id5d56c678ec7343c0a80605a691e0dced"><enum>(5)</enum><header>Response to
		GAO</header>
					<subparagraph id="idD2168CEB02384FE282B7700D33BCDF94"><enum>(A)</enum><header>In
 general</header><text>If a report required under paragraph (4) identifies any deficiencies or delays in any of the elements described in subparagraphs (A) through (E) of paragraph (4) for the agency, the head of the agency shall respond in writing to the Comptroller General of the United States, not later than 90 days after the date on which the report is published under paragraph (4), with a detailed explanation of how the agency will address the deficiency.</text>
					</subparagraph><subparagraph id="id5B48F1E55C4146029FA9008549878E31"><enum>(B)</enum><header>Additional
 requirements</header><text>If the Comptroller General identifies that the agency has repeatedly lagged in implementing the data center consolidation initiative, the Comptroller General may require that the head of the agency submit a statement explaining—</text>
 <clause id="id0e761e1218474e4cb72e2e06ceb75406"><enum>(i)</enum><text>why the agency is having difficulty implementing the initiative; and</text>
 </clause><clause id="id94f8f89ba7cb49a28f7f5b33f96e4ff9"><enum>(ii)</enum><text>what structural or personnel changes are needed within the agency to address the problem.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id3CA9363CBB824DB8B96C7B7B5EF27EC4"><enum>(c)</enum><header>Ensuring
		cybersecurity standards for data center consolidation and cloud
 computing</header><text display-inline="yes-display-inline">The agency required to implement a data center consolidation plan under this Act and migrate to cloud computing shall do so in a manner that is consistent with Federal guidelines on cloud computing security, including—</text>
 <paragraph id="idD8309D23E9874FD09BEC0A9D289FD963"><enum>(1)</enum><text>applicable provisions found within the Federal Risk and Authorization Management Program of the General Services Administration; and</text>
 </paragraph><paragraph id="id7FDD4888092F442E8B9E0F315ED29DB0"><enum>(2)</enum><text>guidance published by the National Institute of Standards and Technology.</text>
				</paragraph></subsection><subsection id="idBBA640D14F504B3388E4EC3FBEEBE08B"><enum>(d)</enum><header>Classified
 information</header><text display-inline="yes-display-inline">The Director of National Intelligence may waive the requirements of this Act for any element (or component of an element) of the intelligence community.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id5C067D2562414243B1D0259CD9BCF294"><enum>(e)</enum><header>Sunset</header><text display-inline="yes-display-inline">This Act is repealed effective on October 1, 2019.</text></subsection></section></legis-body></bill>
