which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Conservation and Production Act to improve the weatherization assistance program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Weatherization Assistance Program Improvements Act of 2023</short-title></quote>.</text></section><section id="idD44DCFBA3CF3487F9D3A7DA8D9D7D796"><enum>2.</enum><header>Weatherization Assistance Program</header><subsection id="id817E1D7285344B51998D975DC0D9446D"><enum>(a)</enum><header>Weatherization Readiness Fund</header><text>Section 414 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6864">42 U.S.C. 6864</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8D2BE833540B49D8845AE032726F7C6F"><subsection id="idC12B4B6829DC465692542E252C68C31E"><enum>(d)</enum><header>Weatherization Readiness Fund</header><paragraph id="ida2d878a266ac488ca0580ddbecbebadf"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a fund, to be known as the <quote>Weatherization Readiness Fund</quote>, from which the Secretary shall distribute funds to States receiving financial assistance under this part, in accordance with subsection (a).</text></paragraph><paragraph id="id7C8B0F8A594A4C26B23222273036F81F"><enum>(2)</enum><header>Use of funds</header><subparagraph id="id9206AB87C1824FDAB44A3A36D0E70FE3"><enum>(A)</enum><header>In general</header><text>A State receiving funds under paragraph (1) shall use the funds for repairs to dwelling units described in subparagraph (B) that will remediate the applicable structural defects or hazards of the dwelling unit so that weatherization measures may be installed.</text></subparagraph><subparagraph id="idF148B5A2E8E3439A815EACD5E7BA79F2"><enum>(B)</enum><header>Dwelling unit</header><text>A dwelling unit referred to in subparagraph (A) is a dwelling unit occupied by a low-income person that, on inspection pursuant to the program under this part, was found to have significant defects or hazards that prevented the installation of weatherization measures under the program.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id932a4a878531451da7f62fe4d176d93d"><enum>(3)</enum><header>Authorization of appropriations</header><text>In addition to amounts authorized to be appropriated under section 422, there is authorized to be appropriated to the Secretary such sums as are necessary to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idB49EFB758B4B4F6794A81C15455B5BB9"><enum>(b)</enum><header>State average cost per unit</header><paragraph id="id8CEE18B1363E44C1932B62EEDB37D7C0"><enum>(1)</enum><header>In general</header><text>Section 415(c) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6865">42 U.S.C. 6865(c)</external-xref>) is amended—</text><subparagraph id="id5430E6E5390447A1B806A27E078F9107"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idDAAA3A87F738487CB81D697B50FD8CA1"><enum>(i)</enum><text>in the matter preceding subparagraph (A)—</text><subclause id="idBBFA1BD5BE87434190A6165CB320BA09"><enum>(I)</enum><text>in the first sentence, by striking <quote>$6,500</quote> and inserting <quote>$12,000</quote>; and</text></subclause><subclause id="idAD3622EE603E4EE1BFFDADFF7CB6468C"><enum>(II)</enum><text>by striking <quote>(c)(1) Except as provided in paragraphs (3) and (4)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idED74F4D6D3C0493287D4548849178107"><subsection id="id6075898DD16847478C91E67C39B625C7"><enum>(c)</enum><header>Financial assistance</header><paragraph id="idCC50A0ABCC0640C5A0CEFA9AA9CBBD85"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (3), (4), and (6)</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id54EC87CB72B9464FB17525F9C8F566D0"><enum>(ii)</enum><text>by conforming the margins of subparagraphs (A) through (D) to the margin of subparagraph (E);</text></clause><clause id="id8B291A723716423CA1D63F1B82FF0F8E"><enum>(iii)</enum><text>in subparagraph (D), by striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text></clause><clause id="id6B0868D7DC324717ACAF083D04AFABD9"><enum>(iv)</enum><text>in subparagraph (E), by adding a period at the end;</text></clause></subparagraph><subparagraph id="idBB1B1D8BB2EB4F7D8AC23F233D30B270"><enum>(B)</enum><text>in paragraph (2), in the first sentence, by striking <quote>weatherized (including dwelling units partially weatherized)</quote> and inserting <quote>fully weatherized</quote>;</text></subparagraph><subparagraph id="idEE27E1E4168F4DBB96F3D94ED9E01976"><enum>(C)</enum><text>in paragraph (4), by striking <quote>$3,000</quote> and inserting <quote>$6,000</quote>;</text></subparagraph><subparagraph id="id3F1FFD8BD1F24EA7BCB90545F5FCCC60"><enum>(D)</enum><text>in paragraph (5)—</text><clause id="id2A66F2CD057344A1851F37DB585EFA06"><enum>(i)</enum><text>in subparagraph (A)(i), by striking <quote>(6)(A)(ii)</quote> and inserting <quote>(7)(A)(ii)</quote>; and</text></clause><clause id="idB1443774B9564D3F8DB8B8B06818F67D"><enum>(ii)</enum><text>by striking <quote>(6)(A)(i)(I)</quote> each place it appears and inserting <quote>(7)(A)(i)(I)</quote>;</text></clause></subparagraph><subparagraph id="id1488B5FBCF704620BBDC68FB0DBFA28F"><enum>(E)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="id2F3E595A928E4587BCEF38A1F3321BA7"><enum>(F)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id033D93B1430A4A82BFE5528DD8016B61"><paragraph id="id06AA4AF03B194D55A9396510A123C5BC"><enum>(6)</enum><header>Limit increase</header><text>The Secretary may increase the amount of financial assistance provided per dwelling unit under this part beyond the limit specified in paragraph (1) if the Secretary determines that market conditions require such an increase to achieve the purposes of this part.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id562777D8F1FE4E75BDFB33D5802408BF"><enum>(2)</enum><header>Conforming amendment</header><text>Section 414D(b)(1)(C) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6864d">42 U.S.C. 6864d(b)(1)(C)</external-xref>) is amended by striking <quote>415(c)(6)(A)</quote> and inserting <quote>415(c)(7)</quote>.</text></paragraph></subsection></section></legis-body></bill>
