<official-title>To increase the penalties for fraudulent 9–1–1 calls that result in an emergency response from law
enforcement agencies, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
<text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Swatting Won't be Accepted or Tolerated Act of 2015</short-title></quote> or the <quote><short-title>SWAT Act</short-title></quote>.</text>
</section><section id="id5774821B6FE54FEFBF0B90744DCA0274"><enum>2.</enum><header>Increased penalties</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text> <paragraph id="id439536A5F50849AAA26C71C880A40ACC"><enum>(1)</enum><text>in section 1001—</text>
<subparagraph id="id3B0BF8532ED44E608503EE55337EEB47"><enum>(A)</enum><text>in subsection (a), in the flush text following paragraph (3), by adding at the end the following: <quote>If the offense involves a false, fictitious, or fraudulent statement or representation, whether written or oral, to a Federal law enforcement agency that causes an emergency Federal law enforcement response, the term of imprisonment shall be not more than 8 years.</quote>; and</text>
</subparagraph><subparagraph id="id5CB12E56A3C4419D9451B5D07A3561CE"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id6B9544269C2C45AB8998A713A3F805C5" style="OLC"> <subsection id="id42A8A643E1A942D4A752D7CD1F893BB5"><enum>(d)</enum><header>Reimbursement</header> <paragraph id="ideac9ffb00b66492697cbd3c60e26c60c"><enum>(1)</enum><header>In general</header><text>The court, in imposing a sentence on a defendant who has been convicted of an offense under subsection (a) that involves a false, fictitious, or fraudulent statement or representation, whether written or oral, to a Federal law enforcement agency that causes an emergency Federal law enforcement response, shall order the defendant to reimburse any Federal, State, or local government incurring expenses incident to any law enforcement emergency or investigative response to that conduct, for those expenses up to $10,000.</text>
</paragraph><paragraph id="id943517365e954d3c962f3954a0730099"><enum>(2)</enum><header>Liability</header><text>A person ordered to make reimbursement under this subsection shall be jointly and severally liable for such expenses with each other person, if any, who is ordered to make reimbursement under this subsection for the same expenses.</text>
</paragraph><paragraph id="id42aedd8353ef4a3e81a5b6ee45af0624"><enum>(3)</enum><header>Civil judgment</header><text>An order of reimbursement under this subsection shall, for the purposes of enforcement, be treated as a civil judgment.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="id8E961E53D28E48D29E7CB98E4062D34E"><enum>(2)</enum><text>in section 1038(c)(1), by—</text> <subparagraph id="idF479E8CC1ACB4EF0A52FE1C2492CFC09"><enum>(A)</enum><text>striking <quote>state or local</quote> and inserting <quote>Federal, State, or local</quote>; and</text>
</subparagraph><subparagraph id="id85A8759CBAC24F308177731A8363853B"><enum>(B)</enum><text>striking <quote>fire or rescue service</quote> and inserting <quote>fire, rescue, or law enforcement service</quote>.</text> </subparagraph></paragraph></section></legis-body> </bill>
