definition of marihuana, and for other purposes.</official-title></form>

<section id="H85CDDD82BFB84FCF9F65911F998BABDD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Therapeutic Hemp Medical Access Act of 2017</short-title></quote>.</text> </section><section id="H8418B2A489C94EE9A255AFAC70332EBE"><enum>2.</enum><header>Exclusion of cannabidiol and cannabidiol-rich plants from definition of marihuana</header> <subsection id="HD6C0B492EDFF4D1896EAF017D62A8C83"><enum>(a)</enum><header>In general</header><text>Section 102(16) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(16)</external-xref>) is amended, in the second sentence—</text>
<paragraph id="idD55A6A67339F4A7186A35F95222D801B"><enum>(1)</enum><text>by striking <quote>or the sterilized seed</quote> and inserting <quote>the sterilized seed</quote>; and</text> </paragraph><paragraph id="id643701F5A7274C788949235E0B27AB5F"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>, cannabidiol, or cannabidiol-rich plants</quote>.</text>
</paragraph></subsection><subsection id="H6FCCACF1846546B090E460C246E25B9D"><enum>(b)</enum><header>Definitions</header><text>Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>), as amended, is further amended by adding at the end the following:</text>

<paragraph id="H8E279D03314F4222A9AC202632F0274A"><enum>(57)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCCE808B872234868A0F0025B7B0474DF"><enum>(A)</enum><text>The term <term>cannabidiol-rich plant</term> means the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a te­tra­hy­dro­can­nab­i­nol concentration of not more than 0.3 percent on a dry weight basis.</text>
</subparagraph><subparagraph id="idB8A94EDDA66D4E2ABFE8DAA5C17A2BA2" indent="up1"><enum>(B)</enum><text>A cannabidiol-rich plant shall not be treated as a controlled substance under this Act.</text> </subparagraph></paragraph><paragraph id="H1A9F02BE3B854F31BFD838AF688E3BAD"><enum>(58)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id76B49EDAD0C24BCA9AA90D3AC79CFE87"><enum>(A)</enum><text>The term <term>cannabidiol</term> means the substance cannabidiol, as derived from a cannabidiol-rich plant.</text>
</subparagraph><subparagraph id="id1A77CEE1D21242F89667F6C743D02D8B" indent="up1"><enum>(B)</enum><text>Cannabidiol shall not be treated as a controlled substance under this Act.</text> </subparagraph></paragraph><paragraph id="id65B22334E1F24576A47AD5EBD49A6F10"><enum>(59)</enum><text>The term <term>tetrahydrocannabinol con­cen­tra­tion</term> means—</text>
<subparagraph id="idCD41DDE686834E558F9AAE966E9DE2E1"><enum>(A)</enum><text>the percent of the delta-9 te­tra­hy­dro­can­nabinol content per dry weight of any part of the plant Cannabis sativa L. or per volume of weight of marihuana product; or</text>
</subparagraph><subparagraph id="id1E0C7CBB8E234025A5511D14A4B63055"><enum>(B)</enum><text>the combined percent of the delta-9 tet­ra­hy­dro­can­nab­i­nol and tet­ra­hy­dro­can­nab­i­nol­ic acid in any part of the plant Cannabis sativa L., regardless of moisture content.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section id="H726A946ED957427C8B6205B62516D88C"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to prohibit or otherwise restrict any activities related to the use, production, or distribution of marijuana in a State in which such activities are legal under State law.</text></section></legis-body></bill>
