<text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Venezuela Humanitarian Assistance and Defense of Democratic Governance Act of 2017</short-title></quote>.</text>

Concerns over PDVSA transactions with Rosneft.</toc-entry> </toc> </subsection></section><section id="id8f1a516bf0a94cbbaceac9a08200514b"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph id="idb4711aa8b30046468e7bc2ca9c7c8b19"><enum>(1)</enum><text>The deterioration of democratic governance and the economic crisis in Venezuela have led to an unprecedented humanitarian situation in which people are suffering from severe shortages of essential medicines and basic food products.</text>
</paragraph><paragraph id="id2abcd88f074540d2a5ffe259f950d4ae"><enum>(2)</enum><text>According to the World Health Organization, Venezuela had a shortage of necessary medications and medical supplies of—</text>
<subparagraph id="id8F7DE25A852D4E79817ED776848CE830"><enum>(A)</enum><text>55 percent in 2014;</text> </subparagraph><subparagraph id="id007CB59798764F06878031B91B3061A3"><enum>(B)</enum><text>67 percent in 2015; and</text>
</subparagraph><subparagraph id="id7BC0393287774F089CB17D075D19A734"><enum>(C)</enum><text>75 percent in 2016.</text> </subparagraph></paragraph><paragraph id="id9b6fc8b8a5ee46f593cef39241009591"><enum>(3)</enum><text>According to a Human Rights Watch 2016 report, it is increasingly difficult for many Venezuelans, particularly those in lower or middle-income families, to obtain adequate nutrition and there are reports of symptoms of malnutrition, particularly in children.</text>
</paragraph><paragraph id="id7b8d29d36cde475b8b95f58a79fcf8b9"><enum>(4)</enum><text>Despite massive shortages of basic foodstuffs and essential medicines, President of Venezuela Nicolás Maduro has rejected repeated requests from the Venezuelan National Assembly and civil society organizations to bring humanitarian aid into the country.</text>
</paragraph><paragraph id="idd23e8118088c4a288b5b97fb246dfd5e"><enum>(5)</enum><text>The International Monetary Fund has estimated that in Venezuela in 2016 the country’s gross domestic product contracted by 12 percent and inflation rate reached 720 percent, and has stated that Venezuela had the worst growth and inflation performance in the world.</text>
</paragraph><paragraph id="id110459a5985a43b9a5657e9eaaf6721d"><enum>(6)</enum><text>The International Monetary Fund has not convened an Article IV Executive Board consultation for Venezuela since September 13, 2004, which greatly limits the extent of information available to the international community about the severity of the Venezuelan economic crisis.</text>
</paragraph><paragraph id="id98cc5158af0d401798676b7ccae50f64"><enum>(7)</enum><text>Venezuela’s political, economic, and humanitarian crisis is fueling social tensions that are resulting in growing incidents of public unrest, looting, violence among citizens, and an exodus of Venezuelans abroad.</text>
</paragraph><paragraph id="id1b00c5af0f9e4f00b1f2f1ab58139715"><enum>(8)</enum><text>These social distortions are taking place amidst an alarming climate of criminal violence. According to the United Nations Office on Drug and Crime, Caracas, Venezuela had the highest per capita homicide rate of any capital city in the world in 2015 at 120 murders per 100,000 citizens.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9e77296b35247e681b3c438c36ec7dd"><enum>(9)</enum><text display-inline="yes-display-inline">In 2016, 18,155 Venezuelans submitted asylum requests in the United States, which was greatest number of requests by any nationality, according to U.S. Citizenship and Immigration Services.</text>
</paragraph><paragraph id="idf9ecb87f92d342c6ba11fef5f47adff5"><enum>(10)</enum><text>International and domestic human rights groups, such as Foro Penal Venezolano, recognize more than 108 political prisoners in Venezuela, including opposition leader and former Chacao mayor Leopoldo López, Judge María Lourdes Afiuni, Caracas Mayor Antonio José Ledezma Díaz, National Assembly Deputy Gilber Caro, and former San Cristobal mayor Daniel Ceballos.</text>
</paragraph><paragraph id="id481f3794cc7e4cbb88b22dca244d857a"><enum>(11)</enum><text>According to media accounts, 29 people lost their lives as the result of public demonstrations and protests in Venezuela in April 2017.</text>
</paragraph></section><section id="id79a17fd8909d4280be949438d709e8d3"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id60e2483bce174576871ec9f77095b9c7"><enum>(1)</enum><text>Venezuelan President Nicolás Maduro should permit the delivery of international humanitarian assistance to address the widespread and deeply concerning shortages of essential medicines and basic food products faced by the people of Venezuela;</text>
</paragraph><paragraph id="idba9c03a5bfe44719938249a7a7ac6c9e"><enum>(2)</enum><text>it is in the best interest of the Venezuelan people for the Government of Venezuela to engage with multilateral and regional economic institutions to ameliorate the effects of the country’s ongoing economic, social, and humanitarian crisis;</text>
</paragraph><paragraph id="id6b2394c13f8b4f8d995d4dd5cc3032b5"><enum>(3)</enum><text>Venezuelan President Nicolás Maduro should immediately release all political prisoners and respect internationally recognized human rights in order to facilitate the conditions for political negotiations and dialogue in Venezuela;</text>
</paragraph><paragraph id="id83606b545c13440c875f21641c4b8d9e"><enum>(4)</enum><text>Venezuelan President Nicolás Maduro and the Supreme Tribunal of Justice of Venezuela should take steps to reinstate the full powers and authorities of the National Assembly of Venezuela in accordance with the Constitution of the Bolivarian Republic of Venezuela;</text>
</paragraph><paragraph id="id27a8ed42b36e4fd29391f9d962a5c8ae"><enum>(5)</enum><text>Venezuela’s National Electoral Council should establish a specific timeline to hold national, regional, and municipal elections in accordance with the Constitution of the Bolivarian Republic of Venezuela; and</text>
</paragraph><paragraph id="iddd16d1b52c594afcbcd5dc5e9b43311d"><enum>(6)</enum><text>the United States should support meaningful efforts towards political negotiations and dialogue through which all parties uphold their commitments and agree to specific deadlines to restore respect for Venezuela’s constitutional mechanisms and resolve the country’s political, economic, and humanitarian crisis.</text>
</paragraph></section><section id="ide6f9d9567b4e4eebb43fd2935ed6efd8"><enum>4.</enum><header>Humanitarian assistance for the people of Venezuela</header>
<subsection id="idbe73f63b6f3d4b939302bf2a08aac3c7"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in coordination with the Administrator of the United States Agency for International Development, subject to the availability of appropriations, shall work through nongovernmental organizations to provide—</text>
<paragraph id="idb9669503d8234ba5b5f66aec476de4cb"><enum>(1)</enum><text>public health commodities to Venezuelan health facilities and services, including medicines on the World Health Organization’s List of Essential Medicines and basic medical supplies and equipment;</text>
</paragraph><paragraph id="idc8e08f52b7aa44ac8a333474f30335e7"><enum>(2)</enum><text>the basic food commodities and nutritional supplements needed to address growing malnutrition and improve food security for the people of Venezuela, with a specific emphasis on the most vulnerable populations;</text>
</paragraph><paragraph id="id28fe2512f6fa44ddb284f0982e82872f"><enum>(3)</enum><text>technical assistance to ensure health and food commodities are appropriately selected, procured, and distributed; and</text>
</paragraph><paragraph id="idc1769775de784ed2b48db5d2436efc2f"><enum>(4)</enum><text>improved transparency and accountability in institutions of the Government of Venezuela, including the publication of official data on public health indicators and shortages of food and medicine.</text>
</paragraph></subsection><subsection id="idbc146c81727b4e079434355b174ff84f"><enum>(b)</enum><header>Strategy requirement</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall submit a strategy for carrying out the activities described in subsection (a) to—</text>
<paragraph id="idd0f431a67948418b9853f6251e1d753b"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text> </paragraph><paragraph id="idEFED6140C441463DAD4972AB41B54096"><enum>(2)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text>
</paragraph><paragraph id="id4FA074B0B88C43C4B432BAB98235E3C5"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text> </paragraph><paragraph id="id0995245E88184F33B0368AE710CDB55B"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text>
</paragraph></subsection><subsection id="id50d7700f4aa44c178f3c77a0bcbb69bd"><enum>(c)</enum><header>Authorization of appropriations</header>
<paragraph id="id2452d59f8709446c8eef848c8e28d455"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary of State $10,000,000 for fiscal year 2018 to carry out the activities set forth in subsection (a) in accordance with this section.</text>
</paragraph><paragraph id="id0007da1c89504189a4ecd82339c7dd55"><enum>(2)</enum><header>Notification requirement</header>
<subparagraph id="id04cf263a71f0492998636469227858cb"><enum>(A)</enum><header>In general</header><text>Amounts appropriated or otherwise made available pursuant to paragraph (1) may not be obligated until 15 days after the date on which the President has provided notice of intent to obligate such funds to the committees listed in subsection (b).</text>
</subparagraph><subparagraph id="id36bea8d8b2634a599fede86284cb8e34"><enum>(B)</enum><header>Waiver</header><text>The Secretary of State may waive the requirement under subparagraph (A) if the Secretary of State determines that failure to waive such requirement would pose a substantial risk to human health or welfare. If such a waiver is invoked, the President shall notify the committees listed in subsection (b) of the intention to obligate funds under this section as early as practicable, but in no event later than 3 days after taking the action to which such notification requirement was applicable in the context of the circumstances necessitating such waiver.</text>
</subparagraph></paragraph></subsection><subsection id="id94c75761c5264e9aa952597de700d7bd"><enum>(d)</enum><header>Briefings</header><text>Upon a request from one of the committees listed in subsection (b), the Secretary of State and the Administrator of the United States Agency for International Development shall brief the committee on the progress made in implementing the strategy submitted under subsection (b).</text>
</subsection></section><section id="ida22bc28beb3d4a0294763019507bf68f"><enum>5.</enum><header>Requirement for strategy to coordinate international humanitarian assistance</header>
<subsection id="id3f60ccaeb8844cd78714c3b8f4473409"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the United Nations humanitarian agencies, including the Office for the Coordination of Humanitarian Affairs, the World Health Organization, the Food and Agriculture Organization, and UNICEF, should conduct and publish an independent assessment on—</text>
<paragraph id="id41EF381016B849A0AE03E5BAC2F9FC9E"><enum>(1)</enum><text>the extent and impact of the shortages of food and medicine in Venezuela; and</text>
</paragraph><paragraph id="id52FBA90996C842EFA1DCC86DC1E4B705"><enum>(2)</enum><text>the efforts needed to resolve such shortages.</text>
</paragraph></subsection><subsection id="idd792a39fc24443fb98fa9d3bfdfb2b3e"><enum>(b)</enum><header>Strategy</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in consultation with the Administrator of the United States Agency for International Development, shall submit a multi-year strategy to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that—</text>
<paragraph id="id2124a25e2dce41ca80895d5d57d3f5bf"><enum>(1)</enum><text>describes how the United States will secure support from international donors, including regional partners in Latin America and the Caribbean, for the provision of humanitarian assistance to the people of Venezuela;</text>
</paragraph><paragraph id="ide2dc5f0d4692443b98500f4ec3d03db4"><enum>(2)</enum><text>identifies governments that are willing to provide financial and technical assistance for the provision of such humanitarian assistance to the people of Venezuela and a description of such assistance; and</text>
</paragraph><paragraph id="idf6859563eaf241abb02e2238e6e8031f"><enum>(3)</enum><text>identifies the financial and technical assistance to be provided by multilateral institutions, including the United Nations humanitarian agencies listed in subsection (a), the Pan American Health Organization, the Inter-American Development Bank, and the World Bank, and a description of such assistance.</text>
</paragraph></subsection><subsection id="idebd5931419b94bae9d0f760fe36fd806"><enum>(c)</enum><header>Diplomatic engagement and coordination</header><text>The Secretary of State, in coordination with the Administrator of the United States Agency for International Development, as appropriate, shall—</text>
<paragraph id="id1bc164b405ee40499889fd692beb8261"><enum>(1)</enum><text>carry out diplomatic engagement to secure contributions of financial and technical assistance from international donors and multilateral institutions in support of the strategy submitted under subsection (b); and</text>
</paragraph><paragraph id="id4f28b3af3bf0437d8ea3e516ae52f12c"><enum>(2)</enum><text>take all necessary steps to ensure effective cooperation among international donors and multilateral institutions in support of such strategy.</text>
</paragraph></subsection><subsection id="id9e16cd98b12147d5b014942b4f7b85ab"><enum>(d)</enum><header>Briefings</header><text>Upon a request from the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> or the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the Secretary of State and the Administrator of the United States Agency for International Development shall brief such committee on the progress made in implementing the strategy submitted under subsection (b).</text>
</subsection></section><section id="idb507d45d5188416ea5f4e552ea10d2cb"><enum>6.</enum><header>Support for Organization of American States Inter-American Democratic Charter</header>
<subsection id="idc6d76a6432bc4cd2802f41c626f34c05"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> <paragraph id="id792f4494a5994ceab0577c0257326bf6"><enum>(1)</enum><text>Article 1 of the Inter-American Democratic Charter, adopted by the Organization of American States in Lima on September 11, 2001, affirms, <quote>The peoples of the Americas have a right to democracy and their governments have an obligation to promote and defend it.</quote>.</text>
</paragraph><paragraph id="id766218b4c64d45f78f39ec10a3ac4bd2"><enum>(2)</enum><text>Article 19 of the Inter-American Democratic Charter states <quote>an unconstitutional interruption of the democratic order or an unconstitutional alteration of the constitutional regime that seriously impairs the democratic order in a member state, constitutes, while it persists, an insurmountable obstacle to its government’s participation in sessions of the General Assembly … and other bodies of the Organization.</quote>.</text>
</paragraph><paragraph id="idddadfd9cd9ec453197580644f8ca8eb8"><enum>(3)</enum><text>Article 20 of the Inter-American Democratic Charter provides—</text> <subparagraph id="id8FF8A5F4A6C5418A94F98F6674AAE26B"><enum>(A)</enum><text><quote>In the event of an unconstitutional alteration of the constitutional regime that seriously impairs the democratic order in a member state, any member state or the Secretary General may request the immediate convocation of the Permanent Council to undertake a collective assessment of the situation and to take such decisions as it deems appropriate.</quote>; and</text>
</subparagraph><subparagraph id="id1445C0ACDEBB466A88692FB2AB26A65B"><enum>(B)</enum><text><quote>The Permanent Council, depending on the situation, may undertake the necessary diplomatic initiatives, including good offices, to foster the restoration of democracy.</quote>.</text>
</subparagraph></paragraph></subsection><subsection id="id61de39e7451145ac8dae086a713c4c98"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> <paragraph id="id4d7423db61e6413db56545637136a43d"><enum>(1)</enum><text>Venezuelan President Nicolás Maduro and the Supreme Tribunal of Justice of Venezuela have carried out systematic efforts to undermine, block, and circumvent the authorities and responsibilities of the Venezuelan National Assembly as mandated in the Constitution of the Bolivarian Republic of Venezuela;</text>
</paragraph><paragraph id="id0dd9d82174e04b00a9f1385848537a78"><enum>(2)</enum><text>such efforts by President Maduro and the Supreme Tribunal of Justice of Venezuela amount to an unconstitutional alternation of the constitutional regime that seriously impairs the democratic order in Venezuela; and</text>
</paragraph><paragraph id="id7e7f79514ee649f6b5e689f8496073eb"><enum>(3)</enum><text>the Secretary of State, working through the United States Permanent Mission to the Organization of American States, should take additional steps to support ongoing efforts by Secretary General Luis Almagro—</text>
<subparagraph id="id7DA860683F97462ABEAF950EE845D1B6"><enum>(A)</enum><text>to invoke the Inter-American Democratic Charter;</text> </subparagraph><subparagraph id="id8ACFE7678EC6480D9A10A29F5D65C835"><enum>(B)</enum><text>to advance a collective assessment of the situation in Venezuela; and</text>
</subparagraph><subparagraph id="id7F2B766EFBE048CA8B12415CF82171A8"><enum>(C)</enum><text>to promote diplomatic initiatives to foster the restoration of Venezuelan democracy.</text>
</subparagraph></paragraph></subsection></section><section id="id74a78a50f80944b89ce188da6d72db2f"><enum>7.</enum><header>Support for international election observation missions and democratic civil society in venezuela</header>
<subsection id="idd922a87e4d5c4591a8739c760617e5a4"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary of State, in coordination with the Administrator of the United States Agency for International Development, shall work—</text>
<paragraph id="idde1e6ba7f6bf46e3acd206afdc6494fc"><enum>(1)</enum><text>with the Organization of American States to ensure credible international observation that contributes to free, fair, and transparent democratic electoral processes in Venezuela; and</text>
</paragraph><paragraph id="id37d8dcdfd926418fbcab162f249e458e"><enum>(2)</enum><text>directly, or through nongovernmental organizations—</text> <subparagraph id="id2d7c052419a441ecb87d7416c8e17e6b"><enum>(A)</enum><text>to defend internationally recognized human rights for the people of Venezuela;</text>
</subparagraph><subparagraph id="ida06c5099c70f4ffdb8b0b3b3f4ccecc9"><enum>(B)</enum><text>to support the efforts of independent media outlets to broadcast, distribute, and share information beyond the limited channels made available by the Government of Venezuela;</text>
</subparagraph><subparagraph id="id2aaaca4f1a7b44b69cd1141428558705"><enum>(C)</enum><text>to facilitate open and uncensored access to the Internet for the people of Venezuela; and</text> </subparagraph><subparagraph id="id5fb9d67a0fd446ae81c77490156b7032"><enum>(D)</enum><text>to combat corruption and improve the transparency and accountability of institutions that are part of the Government of Venezuela.</text>
</subparagraph></paragraph></subsection><subsection id="iddada76e588dc457e88274e6541f1fae9"><enum>(b)</enum><header>Voice and vote at the OAS</header><text>The Secretary of State, acting through the United States Permanent Representative to the Organization of American States, should advocate and build diplomatic support for sending an election observation mission to Venezuela to ensure that democratic electoral processes are organized and carried out in a free, fair, and transparent manner.</text>
</subsection><subsection id="idacd138c0c2614c2f9d1653bd8a814918"><enum>(c)</enum><header>Strategy requirement</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall submit a strategy to carry out the activities described in subsection (a) to—</text>

</paragraph></subsection><subsection id="idf8b009684b34433fa89fb679c2832100"><enum>(d)</enum><header>Authorization of appropriations</header>
<paragraph id="id34392f48e2504030b4e5f2b48aa918b1"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary of State for fiscal year 2018—</text> <subparagraph id="id891bacc4a7f4424a8d596de40b08f03c"><enum>(A)</enum><text>$500,000 to carry out the activities set forth in subsection (a)(1); and</text>
</subparagraph><subparagraph id="id9a6930dd73984a298490a572956ae5fc"><enum>(B)</enum><text>$9,500,000 to carry out the activities set forth in subsection (a)(2).</text> </subparagraph></paragraph><paragraph id="id045cf84d83e24702845755ddfd85cc08"><enum>(2)</enum><header>Notification requirement</header> <subparagraph id="id48d92a804e2a4701a1fa0247f97ef4e8"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), amounts appropriated or otherwise made available pursuant to paragraph (1) may not be obligated until 15 days after the date on which the President has provided notice of intent to obligate such funds to the committees listed in subsection (c).</text>
</subparagraph><subparagraph id="ida74ddd51b66c4380a1ce7975de746e6c"><enum>(B)</enum><header>Waiver</header>
<clause id="id70C1C155527647D686AA2158BC5B6F6B"><enum>(i)</enum><header>In general</header><text>The Secretary of State may waive the notification requirement under subparagraph (A) if the President determines that such requirement would pose a substantial risk to human health or welfare.</text>
</clause><clause id="idEAD4EEACA671468194A8FB808B3DF6D5"><enum>(ii)</enum><header>Notification requirement</header><text>If a waiver is invoked under clause (i), the Secretary of State shall notify the committees listed in subsection (c) of the intention to obligate funds under this section as early as practicable, but in no event later than 3 days after taking the action to which such notification requirement was applicable in the context of the circumstances necessitating such waiver.</text>
</clause></subparagraph></paragraph></subsection><subsection id="id39e1bcf529c045e1bd010a96d728ef0c"><enum>(e)</enum><header>Briefings</header><text>Upon a request from one of the committees listed in subsection (c), the Secretary of State and the Administrator of the United States Agency for International Development shall brief the committee on the progress made in implementing the strategy submitted under subsection (c).</text>
</subsection></section><section id="idba5036607ccf4c0ca8f9de607ba03f34"><enum>8.</enum><header>Support for Caribbean countries</header>
<subsection id="idd68c8ab5b784435b926a642981c4b1ea"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> <paragraph id="idfbdfae36bc2c4570a043d4c9cfc4da3d"><enum>(1)</enum><text>Caribbean countries, despite facing their own challenges, can play a significant role in the Caribbean region by responding to the humanitarian and political crisis in Venezuela.</text>
</paragraph><paragraph id="iddbca03dee53349f5bda86b5d08ece243"><enum>(2)</enum><text>Energy security is a major challenge for Caribbean countries, which depend largely on high-cost imported fuel for electricity generation, and many of which have benefited from preferential treatment by Venezuela.</text>
</paragraph><paragraph id="idaf518501b48246dea1f78fd3ec7cbf17"><enum>(3)</enum><text>Caribbean countries—</text> <subparagraph id="idE50BC683EF6D4D9298DBC364D1B08AC4"><enum>(A)</enum><text>are a market for United States products and services;</text>
</subparagraph><subparagraph id="id2B0EFBBBB6DE44AA8FC21EC4C365F7B9"><enum>(B)</enum><text>have access to renewable and other energy sources; and</text> </subparagraph><subparagraph id="idD7BB35A3EBF041CAA191AD072406DFBF"><enum>(C)</enum><text>can attract financing to develop and implement new energy technologies and approaches, with assistance and through public-private partnerships.</text>
</subparagraph></paragraph></subsection><subsection id="ida7b5ca7d898241d5b4e400eeda8232fa"><enum>(b)</enum><header>Sense of Congress</header><text>It is the Sense of Congress that—</text> <paragraph id="id52d7b9eaa2774861b37180450c5938a9"><enum>(1)</enum><text>the Secretary of State should—</text>
<subparagraph id="idEBA087D18F6C461697A624777DA3BE06"><enum>(A)</enum><text>strengthen the Caribbean Energy Security Initiative; and</text> </subparagraph><subparagraph id="id64E01C5FC43643B588E843CA22CC20CF"><enum>(B)</enum><text>extend current programming, such as the Caribbean Sustainable Energy Road Map and Strategy; and</text>
</subparagraph></paragraph><paragraph id="id44fd564a2b514c109431b458726c03d7"><enum>(2)</enum><text>the Secretary of State, working with the Administrator of the United States Agency for International Development, the Director of the United States Trade and Development Agency, and the President and Chief Executive Officer of the Overseas Private Investment Corporation, should—</text>
<subparagraph id="idE0DA0265B5774A8988FA1FB81BE94F3F"><enum>(A)</enum><text>support the Clean Energy Finance Facility for the Caribbean and Central America to encourage and facilitate regional investments in energy diversification;</text>
</subparagraph><subparagraph id="id66DC894733D94CD79D49FD791C55ECF2"><enum>(B)</enum><text>promote energy efficiency and integration of renewables into Caribbean energy grids; and</text> </subparagraph><subparagraph id="idD5C3B61C5FFD4A7EB829494512BF0064"><enum>(C)</enum><text>promote United States energy missions to the Caribbean.</text>
</subparagraph></paragraph></subsection><subsection id="ide0c3c2c0c17e440eaa3c0b2c9b9cf0d7"><enum>(c)</enum><header>Statement of policy</header><text>According to the United States-Caribbean Strategic Engagement Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/291">Public Law 114–291</external-xref>), it is the policy of the United States to increase engagement with—</text>
<paragraph id="id61F12366093048088853535BB0450C73"><enum>(1)</enum><text>the governments in the Caribbean region; and</text> </paragraph><paragraph id="id6CE5354FBEC04B3989F3099B8C706B42"><enum>(2)</enum><text>the private sector and civil society in the United States and in the Caribbean.</text>
</paragraph></subsection></section><section id="id549a9f31f74c434399ec36beac4c0805"><enum>9.</enum><header>Concerns and report on the involvement of Venezuelan officials in corruption and illicit narcotics
trafficking</header>
<subsection id="id6E3BD13147104461B1FB926FF69654E0"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text> <paragraph id="id19b4e57641af4b4896b06055e6834b92"><enum>(1)</enum><text>The deterioration of governance in Venezuela has been exacerbated by the involvement of senior officials of the Government of Venezuela, including members of the National Electoral Council, the judicial system, and the Venezuelan security forces, in acts of corruption and illicit narcotics trafficking and related money laundering.</text>
</paragraph><paragraph id="id7d97551ed8084f7cb4f5c71c63951f59"><enum>(2)</enum><text>In March 2015, the Department of the Treasury’s Financial Crimes Enforcement Network determined that approximately $2,000,000,000 had been siphoned from Venezuela’s public oil company, Petróleos de Venezuela S.A., in conjunction with its designation of the Banca Privada d’Andorra as a Foreign Financial Institution of Primary Money Laundering Concern.</text>
</paragraph><paragraph id="ida4e420e2d3f0404486c06dcc6df504ff"><enum>(3)</enum><text>On August 1, 2016, General Nestor Reverol, Venezuela’s current Minister of Interior and former National Guard commander, was indicted in a United States district court for participating in an international cocaine trafficking conspiracy.</text>
</paragraph><paragraph id="id93036f5a86a543dab6b31ea490c02d07"><enum>(4)</enum><text>On November 18, 2016, Franqui Francisco Flores de Freitas and Efrain Antonio Campo Flores, nephews of President Maduro and Venezuelan First Lady Cilia Flores, were convicted in a United States district court on charges of conspiring to import cocaine into the United States.</text>
</paragraph><paragraph id="id8cc3b0ba21e841ca8b75d1f27acf747e"><enum>(5)</enum><text>On February 13, 2017, the Department of the Treasury’s Office of Foreign Assets Control designated Venezuelan Vice President Tareck Zaidan El Aissami Maddah for his involvement in illicit narcotics trafficking, pursuant to the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1901">21 U.S.C. 1901</external-xref> et seq.; title VIII of <external-xref legal-doc="public-law" parsable-cite="pl/106/120">Public Law 106–120</external-xref>).</text>
</paragraph><paragraph id="id50bb4afce40b43b59664a62ed702dbb1"><enum>(6)</enum><text>The Department of the Treasury’s Office of Foreign Assets Control has designated additional individuals and senior Venezuelan officials for their involvement in illicit narcotics trafficking, pursuant to such Act, including—</text>
<subparagraph id="idf9080d16914148b9869f0d1d636099d0"><enum>(A)</enum><text>Venezuelan national Samark Jose Lopez Bello, who is the primary front man and money launderer for Tareck Zaidan El Aissami Maddah;</text>
</subparagraph><subparagraph id="id8221da8f0c5144238bda6c81d04eae88"><enum>(B)</enum><text>Hugo Armando Carvajal Barrios, who is the current National Assembly Deputy and the former Director of Venezuela’s Military Intelligence Directorate;</text>
</subparagraph><subparagraph id="id8ec768a777f54b5792770a4555babdac"><enum>(C)</enum><text>Henry de Jesus Rangel Silva, who is the current Governor of Trujillo State and the former Director of Venezuela’s Directorate of Intelligence and Prevention Services;</text>
</subparagraph><subparagraph id="id51af007cf58a456998a9ba2640749eb9"><enum>(D)</enum><text>Ramon Emilio Rodriguez Chacin, who previously served as the Minister of Interior; and</text> </subparagraph><subparagraph id="ida13826b19212425cacc259bdc9b1ca97"><enum>(E)</enum><text>Freddy Alirio Bernal Rosales, who previously served as the Mayor of the Libertador municipality of Caracas.</text>
</subparagraph></paragraph></subsection><subsection id="id2366abdef47846e1ab572d00aae544eb"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="ida068faaaa4fb4135ac6b50aa7487bda7"><enum>(1)</enum><header>Corruption</header><text>The term <term>corruption</term> means the extent to which public power is exercised for private gain, including by bribery, nepotism, fraud, or embezzlement.</text>
</paragraph><paragraph id="idd06d3c7d9b444a4a94eedc33c4bbf2bc"><enum>(2)</enum><header>Grand corruption</header><text>The term <term>grand corruption</term> means corruption committed at a high level of government that—</text> <subparagraph id="id99557e485c6e4484abd78d8cce5de47d"><enum>(A)</enum><text>distorts policies or the central functioning of the country; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id700fcac85d464b8bbbe44a93d19aecbe"><enum>(B)</enum><text>enables leaders to benefit at the expense of the public good.</text> </subparagraph></paragraph></subsection><subsection id="id973414df71de46a39636687c33265a17"><enum>(c)</enum><header>Reporting requirement</header> <paragraph id="id81D87F4C5EF54EB39E95ED29EF475BDC"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, acting through the Bureau of Intelligence and Research, and in consultation with the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>)), shall submit a report to Congress that describes the involvement of senior officials of the Government of Venezuela, including members of the National Electoral Council, the judicial system, and the Venezuelan security forces, in acts of corruption in Venezuela, with a specific emphasis on acts of grand corruption.</text>
</paragraph><paragraph id="idbacff76f0add484f857eac2059e4579a"><enum>(2)</enum><header>Additional elements</header><text>The report submitted under paragraph (1) shall—</text> <subparagraph id="id0e308f7807164a7a800995b9efdba122"><enum>(A)</enum><text>describe how the acts of corruption described in the report pose direct challenges for United States national security and international security;</text>
</subparagraph><subparagraph id="id4409a746bd3d44d6bdf0d915a64f51c6"><enum>(B)</enum><text>identify individuals that frustrate the ability of the United States to combat illicit narcotics trafficking; and</text>
</subparagraph><subparagraph id="id851e35b6ef854ae5a5a5478ff8a7cf3b"><enum>(C)</enum><text>include input from the Drug Enforcement Administration, the Office of Foreign Assets Control, and the Financial Crimes Enforcement Network.</text>
</subparagraph></paragraph><paragraph id="id8531b36d1260491cbd4bc49492dcfc40"><enum>(3)</enum><header>Form</header><text>The report under paragraph (1) shall be submitted in unclassified form, but may include a classified annex. The unclassified portion of the report shall be made available to the public.</text>
</paragraph></subsection></section><section id="id81fb0b01c60a423a820d8d93350a4cbc"><enum>10.</enum><header>Sanctions on persons responsible for public corruption and undermining democratic governance in
Venezuela</header>
<subsection commented="no" display-inline="no-display-inline" id="id9FE26533BE394BEEA08D59CC1777E9FF"><enum>(a)</enum><header display-inline="yes-display-inline">Finding</header><text display-inline="yes-display-inline">Executive Order 13692 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), which was signed on March 8, 2015, established sanctions against individuals responsible for undermining democratic processes and institutions and involved in acts of public corruption that were not included in the Venezuela Defense of Human Rights and Civil Society Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/278">Public Law 113–278</external-xref>).</text>
</subsection><subsection id="iddedf30b3e75e4b0b96d717cca6450075"><enum>(b)</enum><header>Sanctions</header><text>Section 5 of the Venezuela Defense of Human Rights and Civil Society Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/278">Public Law 113–278</external-xref>) is amended—</text>
<paragraph id="id93dcfac5f130419997be8b7b5622e3d1"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="id0FDB8C8C4A8E479C92C65DCA92ED9578"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text>
</subparagraph><subparagraph id="id9AB9ADE1857B4D15BDFED79AEA641B91"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (5); and</text> </subparagraph><subparagraph id="idc197ff38427f4276b1ff1d1c8eb4993f"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text>

</subparagraph></paragraph><paragraph id="id4c0b21f280a54a3cbb0f3c888e045c1e"><enum>(2)</enum><text>by redesignating subsections (e) and (f) as subsections (f) and (g), respectively;</text> </paragraph><paragraph id="idF1851AE327994C49BF0433436AB7171C"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text>

</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D4513F8A7AB45EC8B9BDA4F808111DE"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (f), as redesignated, by striking <quote>December 31, 2019</quote> and inserting <quote>December 31, 2022</quote>.</text> </paragraph></subsection></section><section id="id506f7ffd9bfb4958a6c32a00dbedbcda"><enum>11.</enum><header>Concerns over PDVSA transactions with Rosneft</header> <subsection id="ideadd8f800b184727a3fb7da1a8ecb5fa"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text>
<paragraph id="idfff9ef5dca9142ab974b28e957985ef6"><enum>(1)</enum><text>In late 2016, Venezuelan state owned oil company Petróleos de Venezuela, S.A. (referred to in this section as <quote>PDVSA</quote>), through a no-compete transaction, secured a loan from Russian government-controlled oil company Rosneft, using 49.9 percent of PDVSA’s American subsidiary, CITGO Petroleum Corporation, including its assets in the United States, as collateral. As a result of this transaction, 100 percent of CITGO is held as collateral by PDVSA’s creditors.</text>
</paragraph><paragraph id="id47f66c2535a147fcbda01d68cf30b477"><enum>(2)</enum><text>CITGO, a wholly owned subsidiary of PDVSA, is engaged in interstate commerce and owns and controls critical energy infrastructure in 19 States in the United States, including an extensive network of pipelines, 48 terminals, and 3 refineries, with a combined oil refining capacity of 749,000 barrels per day. CITGO’s refinery in Lake Charles, Louisiana, is the sixth largest refinery in the United States.</text>
</paragraph><paragraph id="id80d3616b858045b898e2a66dd76bbf5b"><enum>(3)</enum><text>The Department of the Treasury imposed sanctions on Rosneft, which is controlled by the Russian Government, and its Executive Chairman, Igor Sechin, following Russia’s military invasion of Ukraine and its illegal annexation of Crimea in 2014.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCB8B8DE6E3D405F993A04B217CB43E3"><enum>(4)</enum><text display-inline="yes-display-inline">The Department of Homeland Security has designated the energy sector as critical to United States infrastructure.</text>
</paragraph><paragraph id="idf693f464560d46cc8632b203834c03e0"><enum>(5)</enum><text>The growing economic crisis in Venezuela raises the probability that the Government of Venezuela and PDVSA will default on their international debt obligations, resulting in a scenario in which Rosneft could come into control of CITGO’s United States energy infrastructure holdings.</text>
</paragraph></subsection><subsection id="id08102ced2d2249ee8c224813650850cd"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> <paragraph id="id26ECCE41C2B44754AFE3A3F6CD1A62D6"><enum>(1)</enum><text>control of critical United States energy infrastructure by Rosneft, a Russian government-controlled entity currently under United States sanctions, would pose a significant risk to United States national security and energy security;</text>
</paragraph><paragraph id="idf17409a65ea442a6adcda868c789cddb"><enum>(2)</enum><text>the President should take all necessary steps to prevent Rosneft from gaining control of critical United States interstate energy infrastructure;</text>
</paragraph><paragraph id="id3f91573ca16d437791e64a1701b4a301"><enum>(3)</enum><text>a default by PDVSA on its loan from Rosneft, resulting in Rosneft coming into possession of PDVSA’s United States CITGO assets, would warrant careful consideration by the Committee on Foreign Investment in the United States;</text>
</paragraph><paragraph id="id82d28cee5bf94ab3adfc5c8921518388"><enum>(4)</enum><text>if PDVSA defaults on its debt obligations, the Department of the Treasury’s Office of Foreign Asset Control should review CITGO’s transactions with United States persons to assess and ensure compliance with United States sanctions policies and regulations; and</text>
</paragraph><paragraph id="id11ea84e9e4744bf1905db9e29104bd7a"><enum>(5)</enum><text>the Department of Homeland Security should conduct an assessment of the security risks posed by foreign control of CITGO’s United States energy infrastructure holdings.</text></paragraph></subsection></section></legis-body>
