construction of a road between King Cove and Cold Bay. </official-title></form>
<legis-body display-enacting-clause="yes-display-enacting-clause">
<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>King Cove Road Land Exchange Act</short-title></quote>.</text>
</section><section id="id5D670BA17ED844339FBF7F0FBC06F7CD"><enum>2.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the land exchange required under this Act (including the designation of the road corridor and the construction of the road along the road corridor) is in the public interest.</text>
</section><section commented="no" display-inline="no-display-inline" id="id6cf3e7105b5047c7aa8b48dbbd875888"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id1ff070f1d0014f82a1b446c2da6f4113"><enum>(1)</enum><header display-inline="yes-display-inline">Federal land</header> <subparagraph commented="no" display-inline="no-display-inline" id="ide551cd2414ac4f45adbca69ccdd67079"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means the approximately 206 acres of Federal land located within the Refuge as depicted on the map entitled <quote>Project Area Map</quote> and dated September 2012.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf223f439e1f24246a7a0fc697e2788d9"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>Federal land</term> includes the 131 acres of Federal land in the Wilderness, which shall be used for the road corridor along which the road is to be constructed in accordance with section 4(b)(2).</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida36e28b54350438895dbf37e2d64c456"><enum>(2)</enum><header display-inline="yes-display-inline">Non-Federal land</header><text display-inline="yes-display-inline">The term <term>non-Federal land</term> means the approximately 43,093 acres of land owned by the State as depicted on the map entitled <quote>Project Area Map</quote> and dated September 2012.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided36a4bf23bd407ca7b41479fa069daf"><enum>(3)</enum><header display-inline="yes-display-inline">Refuge</header><text display-inline="yes-display-inline">The term <term>Refuge</term> means the Izembek National Wildlife Refuge in the State.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id508d3c3bbafe4405894d0d45287f7b8d"><enum>(4)</enum><header display-inline="yes-display-inline">Road corridor</header><text display-inline="yes-display-inline">The term <term>road corridor</term> means the road corridor designated under section 4(b)(1).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9fcc6415b594d7792d36c314c33c557"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8625e1cf75564b7c9e4071c8213e9128"><enum>(6)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State of Alaska.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id963f7d1d1dcc4047a89dce02eda7f0cc"><enum>(7)</enum><header display-inline="yes-display-inline">Wilderness</header><text display-inline="yes-display-inline">The term <term>Wilderness</term> means the Izembek Wilderness designated by section 702(6) of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/96/487">Public Law 96–487</external-xref>).</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="idc83ab2e6159a499b8fcb51a131852b3c"><enum>4.</enum><header display-inline="yes-display-inline">Land exchange required</header>
<subsection commented="no" display-inline="no-display-inline" id="idaae56171e0084706a364fcd4d2ba9cfe"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the State offers to convey to the Secretary all right, title, and interest of the State in and to the non-Federal land, the Secretary shall convey to the State all right, title, and interest of the United States in and to the Federal land.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id562c580ca9fe4925a41f1810dbcf897b"><enum>(b)</enum><header display-inline="yes-display-inline">Use of federal land</header><text display-inline="yes-display-inline">The Federal land shall be conveyed to the State for the purposes of—</text> <paragraph commented="no" display-inline="no-display-inline" id="id9e9783217caf4942a1ba81ea107f6145"><enum>(1)</enum><text display-inline="yes-display-inline">designating a road corridor through the Refuge; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3553eabd96cd453f8ca40ce45c3f48dd"><enum>(2)</enum><text display-inline="yes-display-inline">constructing a single-lane gravel road along the road corridor subject to the requirements in section 6.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id24a73b38367a4048befe52d5454ef846"><enum>(c)</enum><header display-inline="yes-display-inline">Valuation, appraisals, and equalization</header>
<paragraph commented="no" display-inline="no-display-inline" id="ida64acb44226341cc93d393848fb33d27"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The value of the Federal land and the non-Federal land to be exchanged under this section—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id91b21179a80b410a8a05da9dd53d2904"><enum>(A)</enum><text display-inline="yes-display-inline">shall be equal, as determined by appraisals conducted in accordance with paragraph (2); or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id036f1824b79145019480f3d1c52e9b3c"><enum>(B)</enum><text display-inline="yes-display-inline">if not equal, shall be equalized in accordance with paragraph (3).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2b0752579f143718be67ad103d2cfdf"><enum>(2)</enum><header display-inline="yes-display-inline">Appraisals</header> <subparagraph commented="no" display-inline="no-display-inline" id="idf6022922378c4b16bfdd42c1dc25368e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary and State shall select an appraiser to conduct appraisals of the Federal land and non-Federal land.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id764d539a872c4027b27806c3da8a8d83"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The appraisals required under subparagraph (A) shall be conducted in accordance with nationally recognized appraisal standards, including—</text>
<clause commented="no" display-inline="no-display-inline" id="ide6be0f882d6b4d5b87bc6c914939a1a8"><enum>(i)</enum><text display-inline="yes-display-inline">the Uniform Appraisal Standards for Federal Land Acquisitions; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id3ce69da8f0a84bc89eede4f48755316d"><enum>(ii)</enum><text display-inline="yes-display-inline">the Uniform Standards of Professional Appraisal Practice.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9a983f07397411ea65e3b047799e43f"><enum>(3)</enum><header display-inline="yes-display-inline">Equalization</header>
<subparagraph commented="no" display-inline="no-display-inline" id="idd717c744dc0b45db857a00f84874bb45"><enum>(A)</enum><header display-inline="yes-display-inline">Surplus of federal land</header><text display-inline="yes-display-inline">If the final appraised value of the Federal land exceeds the final appraised value of the non-Federal land to be conveyed under the land exchange under this section, the value of the Federal land and non-Federal land shall be equalized—</text>
<clause commented="no" display-inline="no-display-inline" id="id61942cc77f494df7aafcf4163a5a7ef7"><enum>(i)</enum><text display-inline="yes-display-inline">by conveying additional non-Federal land in the State to the Secretary, subject to the approval of the Secretary;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id3d0426b6f5e14e4ab19700434edfcf3d"><enum>(ii)</enum><text display-inline="yes-display-inline">by the State making a cash payment to the United States; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="id458d876c77e14469a2ea3921b223917c"><enum>(iii)</enum><text display-inline="yes-display-inline">by using a combination of the methods described in clauses (i) and (ii).</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd6a1cf0c96a49e996605422e8849ffc"><enum>(B)</enum><header display-inline="yes-display-inline">Surplus of non-federal land</header><text display-inline="yes-display-inline">If the final appraised value of the non-Federal land exceeds the final appraised value of the Federal land to be conveyed under the land exchange under this section, the value of the Federal land and non-Federal land shall be equalized by the State adjusting the acreage of the non-Federal land to be conveyed.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06ee43304ba14bb59163cfe0449fe8d2"><enum>(C)</enum><header display-inline="yes-display-inline">Amount of payment</header><text display-inline="yes-display-inline">Notwithstanding section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>), the Secretary may accept a payment under subparagraph (A)(ii) in excess of 25 percent of the value of the Federal land conveyed.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id03d91f2b214041cfaba7b32901549b15"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">On completion of the exchange of Federal land and non-Federal land under this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="id38857ca9fcea44588b83120f256d2ca2"><enum>(1)</enum><text display-inline="yes-display-inline">the boundary of the Wilderness shall be modified to exclude the Federal land; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb50dd4bb588403cab9ba1db2b2f68e1"><enum>(2)</enum><text display-inline="yes-display-inline">the non-Federal land shall be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idb3c94b67375e413ba9350b1da9a812a8"><enum>(A)</enum><text display-inline="yes-display-inline">added to the Wilderness; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f0e691246c0468da503acb65e869fd4"><enum>(B)</enum><text display-inline="yes-display-inline">administered in accordance with—</text> <clause commented="no" display-inline="no-display-inline" id="id9010a2aa2fa94c9ca2efac48142f521d"><enum>(i)</enum><text display-inline="yes-display-inline">the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.); and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id8aa7f36f014048d58b82fed76fa9cbad"><enum>(ii)</enum><text display-inline="yes-display-inline">other applicable laws.</text> </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd75f7606661145e3ab12d617cfd6aa9e"><enum>(e)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">The land exchange under this section shall be completed not later than 180 days after the date of enactment of this Act.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="id6d1cbb2c913d48c0b2de19ca36d7a4f1"><enum>5.</enum><header display-inline="yes-display-inline">Route of road corridor</header><text display-inline="no-display-inline">The route of the road corridor shall follow the southern road alignment as described in the alternative entitled <quote>Alternative 2-Land Exchange and Southern Road Alignment</quote> in the final environmental impact statement entitled <quote>Izembek National Wildlife Refuge Land Exchange/Road Corridor Final Environmental Impact Statement</quote> and dated February 5, 2013.</text>
</section><section commented="no" display-inline="no-display-inline" id="id0410a1c8ca3b4e5a9d010a2927eefa68"><enum>6.</enum><header display-inline="yes-display-inline">Requirements relating to road</header><text display-inline="no-display-inline">The requirements relating to usage, barrier cables, and dimensions and the limitation on support facilities under subsections (a) and (b) of section 6403 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1180) shall apply to the road constructed in the road corridor.</text>
</section><section commented="no" display-inline="no-display-inline" id="id485e3d704ed0436e8c105fce072cbda6"><enum>7.</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="no-display-inline">The exchange of Federal land and non-Federal land and the road to be constructed under this Act (including the issuance of any permit that may be required from any Federal agency to construct the road) shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></section></legis-body></bill>
