of critical communications networks during times of emergency, and for

<section commented="no" display-inline="no-display-inline" id="id1b9591e1-6177-4f3d-b6e9-a5512e04a0ea" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Access to Networks in Disasters Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="ide63df37b-2887-464b-9768-dacb4fbe337f" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the voluntary policies outlined in the Wireless Network Resiliency Cooperative Framework should be adhered to by all parties to aid consumers, 9–1–1 professionals, first responders, and local governments, in accessing communication services during times of emergency.</text>
</section><section commented="no" display-inline="no-display-inline" id="idbd9a602b-14e2-47b8-93de-3737915b439d" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Securing access to networks in disasters</header>
<subsection commented="no" display-inline="no-display-inline" id="ide5ef92e9-4636-4d4f-b748-b7e7af3b26f7"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="id23b0736d-144b-4f6a-aad5-2734bdf062c1"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Commission</term> means the Federal Communications Commission;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id425e18c5-f3b5-4f37-85ae-a3e619358540"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>mobile service</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id806fee3d-8b12-411b-b74a-5986327e4cf2"><enum>(A)</enum><text display-inline="yes-display-inline">commercial mobile service (as defined in section 332 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332</external-xref>)); or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4bad3e7-b07f-43ba-a1f6-e6e0a307af1b"><enum>(B)</enum><text display-inline="yes-display-inline">commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id400c5e72-555b-48a4-acb0-e4fac78c65e7"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>times of emergency</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id0aa2d3f8-196e-4c4d-b60d-92f52545f1e1"><enum>(A)</enum><text display-inline="yes-display-inline">an emergency or major disaster, as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>); or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac5eed54-3159-4587-9ceb-e0aabf473185"><enum>(B)</enum><text display-inline="yes-display-inline">an emergency as declared by the Governor of a State or territory of the United States; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb164125-2fa7-4ec1-aca5-e2717173ade5"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>WiFi access points</term> means wireless Internet access using the standard designated as 802.11 or any variant thereof.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb9819b42-13df-4716-bd22-49bd9b0e1a91"><enum>(b)</enum><header display-inline="yes-display-inline">FCC study on alternative access to 9–1–1 services during times of emergency</header>
<paragraph commented="no" display-inline="no-display-inline" id="idf3c1ebaf-eb5f-47bb-b58e-1170c04e053f"><enum>(1)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">Not later than 36 months after the date of enactment of this Act, the Commission shall submit to Congress, and make publicly available on the website of the Commission, a study on the public safety benefits and technical feasibility and cost of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id3d803ad9-8f8a-4770-a0d3-52edb53d2bfe"><enum>(A)</enum><text display-inline="yes-display-inline">making telecommunications service provider-owned WiFi access points, and other telecommunications service provider-owned communications technologies operating on unlicensed spectrum, available to the general public for access to 9–1–1 services, without requiring any login credentials, during times of emergency when mobile service is unavailable;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05e7cfcc-2fed-4786-afa9-a8b6cc937910"><enum>(B)</enum><text display-inline="yes-display-inline">the provision by non-telecommunications service provider-owned WiFi access points of public access to 9–1–1 services during times of emergency when mobile service is unavailable; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5adc29c5-eff2-42db-bcb4-9150f44cc67e"><enum>(C)</enum><text display-inline="yes-display-inline">other alternative means of providing the public with access to 9–1–1 services during times of emergency when mobile service is unavailable.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id648fc755-417b-4a38-ba7b-55867088e6d3"><enum>(2)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In conducting the study required under paragraph (1), the Commission shall consider issues related to making WiFi access points available to the general public for access to 9–1–1 services, including communications network provider liability, the operational security of communications networks, and any existing actions or authorities in and among the States.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5d72cfef-7638-4392-a649-fb65bb5104d5"><enum>(c)</enum><header display-inline="yes-display-inline">GAO study and report</header>
<paragraph commented="no" display-inline="no-display-inline" id="idbb399343-d977-4ee3-ad5e-294751b8eb83"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3ff9b76b-b418-470e-b4ac-ec03bfe78305"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>essential communications services</term> means wireline and mobile telephone service, Internet access service, radio and television broadcasting, cable service, and direct broadcast satellite service; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79734c59-8673-4a25-a6f0-146aa2ae513c"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>Executive departments</term> has the meaning given the term in section 101 of title 5, United States Code.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id507ff6c7-3bdc-4cbd-be0c-b7996bdc5b3f"><enum>(2)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study on—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id4d5bec90-11af-4d4d-8579-d28d2ed6dc37"><enum>(A)</enum><text display-inline="yes-display-inline">how Executive departments can better ensure essential communications services remain operational during times of emergency;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e012c80-0155-4e08-b30c-60682237f26a"><enum>(B)</enum><text display-inline="yes-display-inline">any legislative matters, if appropriate, Congress could consider to help promote the resiliency of essential communications services; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89393b6d7bbe41b6b38a45c688580f19"><enum>(C)</enum><text display-inline="yes-display-inline">whether a nationwide directory of points of contact among providers of essential communications services is needed to facilitate the rapid restoration of such services damaged during times of emergency.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC31BFA313E9C4ED7962E6A7A7B86FF46"><enum>(3)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In making the determination described in paragraph (2)(C), the Comptroller General shall consider—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id1c95317aff8d4d00893d7e5c53351528"><enum>(A)</enum><text display-inline="yes-display-inline">any similar directories that exist at the Federal, State, or local level, including the effectiveness of such directories;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3e35f0819354e1ca82b8a6c064932b2"><enum>(B)</enum><text display-inline="yes-display-inline">how such a directory could be established and updated, including what types of information would be most useful;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24cb6e932495450888803f50de31cbd1"><enum>(C)</enum><text display-inline="yes-display-inline">how access to such a directory could be managed to adequately ensure the confidentiality of any sensitive information and operational security of essential communications services; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32d5469ebb2e4ff8a253be31f52b9ab3"><enum>(D)</enum><text display-inline="yes-display-inline">the resources necessary to establish and maintain such a directory.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida26ff21a-09ed-4327-b348-741893c2ee74"><enum>(4)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit a report to Congress containing the findings and recommendations of the study required under paragraph (2).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id894cb264-a2e7-4b1a-9369-9f803c9a73fc"><enum>(d)</enum><header display-inline="yes-display-inline">Expanding list of essential service providers during federally declared emergencies To include all
communications providers; providing access to essential service providers</header><text display-inline="yes-display-inline">Section 427 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189e">42 U.S.C. 5189e</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id7835ed39-1cd1-4407-8683-5e4b27c480ae"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(A), by striking <quote>telecommunications service</quote> and inserting <quote>wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service</quote>; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb798a61a-5702-471d-80d0-5cb8e2790b37"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id24b374af-e2fc-4b7f-86e0-96993232427e" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idf7208b50-6150-4ce7-889f-8012bf5bd901"><enum>(d)</enum><header display-inline="yes-display-inline">Mutual aid agreements</header><text display-inline="yes-display-inline">The President, acting through the Administrator of the Federal Emergency Management Agency, shall encourage the adoption of mutual aid agreements that recognize the credentials of essential service providers issued by all parties to the mutual aid agreement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6c23ccc9-0786-4fe1-9046-cb0ed22ca77c"><enum>(e)</enum><header display-inline="yes-display-inline">Communications networks are designated essential assistance during federally declared emergencies</header><text display-inline="yes-display-inline">Section 403(a)(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(a)(3)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id9faac4c5-e21c-4ae4-9775-d6e64d21992d"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (I), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8962705e-70e3-446c-9a5c-5bab2264fa10"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc704ccc-b070-4ac6-b51d-aa9389367cac"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idb9322e6d-9726-4fd7-8224-40d17b4e0622" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="idbb70a31a-2e11-442e-a009-95eee201bf72"><enum>(K)</enum><text display-inline="yes-display-inline">allowing for access to essential service providers necessary for establishing temporary or restoring wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20170911">Passed the Senate September 11, 2017.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
