which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require that certain aliens receive written notice of removal proceedings before being granted parole or released from detention and to enumerate the possible consequences for failing to attend such proceedings.</official-title></form><legis-body><section id="id8B19F3AE613E47FC9E9110D0C24BAE4A" section-type="section-one"><enum>1.</enum><header>Written notice of removal proceedings</header><subsection id="id0C7BC9C236F44AB899EE619AD26A2AC9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 235(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDACDD23F3E1A40A4A645B3D514F1964E"><paragraph id="id29cac054d8444ce8923f68aca49aad00"><enum>(4)</enum><header>Written notice</header><text>An alien described in this subsection shall not be granted parole or released from detention by the Attorney General or the Secretary of Homeland Security without having been provided a written notice under paragraph (1) or (2) of section 239(a) that—</text><subparagraph id="id20544FFF6784418CA8FA766C5B71928B"><enum>(A)</enum><text>informs the alien that he or she is required to appear before an immigration judge for removal proceedings; and</text></subparagraph><subparagraph id="id14E5055F82104B5EA1C309E562DFD929"><enum>(B)</enum><text>identifies the specific date on which such proceedings will take place.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id762B7C53C4CE4DF889F35D68C443667D"><enum>(b)</enum><header>Consequences for failure To attend hearing</header><text>Section 240(b)(5)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(b)(5)(A)</external-xref>) is amended—</text><paragraph id="idAC6FFB517ABB45168A14640E9F4CABAA"><enum>(1)</enum><text>by striking <quote>Any alien</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEAD44E3AAC5C46479840E343149F5C84"><clause id="id3134176C07994DC5BFF0A174885B0557"><enum>(i)</enum><header>Removal</header><text>Any alien</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id43DB9D814A2B420F9D78CCB13A506C90"><enum>(2)</enum><text>by striking <quote>the Service</quote> and inserting <quote>U.S. Immigration and Customs Enforcement</quote>; and</text></paragraph><paragraph id="id31B21A6C816A46FB90E75852AF903061"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC490742583B4E168C2DBE1E8BE1F8DD"><clause id="id634836A509F34B5A8E1AE63A06F894DF"><enum>(ii)</enum><header>Additional consequences for failure to attend proceeding</header><text>Absent exceptional circumstances, the failure of an alien to attend a proceeding referred to in clause (i) shall result in the immediate termination of—</text><subclause id="id134DFA807FDB473589F86FA908452C61"><enum>(I)</enum><text>the alien’s parole;</text></subclause><subclause id="id8E2A94B7C728449E98046DAC1E58BC8B"><enum>(II)</enum><text>deferred action; </text></subclause><subclause id="id39DBA0D3DE31449594A488540619714A"><enum>(III)</enum><text>temporary protected status under section 244;</text></subclause><subclause id="id2FA98AE881684C4795FE9EEB964D92F4"><enum>(IV)</enum><text>any other immigration status; and</text></subclause><subclause id="id769A390003014F198C0933372CC1B14D"><enum>(V)</enum><text>any employment authorization associated with any status set forth in subclauses (I) through (IV).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6FA136A0DB4D4D0BBA2E79301D5EADD3"><enum>(c)</enum><header>Savings provision</header><text>None of the amendments made by this Act may be construed as authorizing the parole or release of any alien if such parole or release is not otherwise expressly authorized by law.</text></subsection></section></legis-body></bill>
