<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1039</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210325">March 25, 2021</action-date><action-desc><sponsor name-id="S306">Mr. Menendez</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to improve compensation for disabilities occurring in Persian Gulf War veterans, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id17F55E272F3C4E67970D978E74A978F3"><enum>1.</enum><header>Improving compensation for disabilities occurring in Persian Gulf War veterans</header><subsection id="id961825CB883A4824B8865A0789D503EA"><enum>(a)</enum><header>Reduction in threshold of eligibility</header><text>Subsection (a)(1) of section 1117 of title 38, United States Code, is amended by striking <quote>became manifest—</quote> and all that follows through the period at the end and inserting <quote>became manifest to any degree at any time</quote>.</text></subsection><subsection id="id8212BED1C62F40F5B98FF62F00AB35D4"><enum>(b)</enum><header>Permanent extension of period of eligibility</header><paragraph id="id41437E4486ED4C55AC2DD50782C7027A"><enum>(1)</enum><header>In general</header><text>Such section is amended by striking subsection (b).</text></paragraph><paragraph id="id7C795DB1B47B44E5A943B855A4C23B6E"><enum>(2)</enum><header>Conforming amendments</header><text>Such section, as amended by paragraph (1), is further amended—</text><subparagraph id="idEFBE65B3452F4E4682FCF0C9A5BEF771"><enum>(A)</enum><text>by redesignating subsections (c) and (d) as subsections (b) and (c), respectively; and</text></subparagraph><subparagraph id="idB83B0C9DB5334D5EB0DEE4E589110B13"><enum>(B)</enum><text>in subsection (a)(2)(C), by striking <quote>under subsection (d)</quote> and inserting <quote>under subsection (c)</quote>.</text></subparagraph></paragraph></subsection><subsection id="idBE0D32E6BB9B44898A431AEC12731862"><enum>(c)</enum><header>Establishing singular Disability Based Questionnaire</header><text>Such section, as amended by subsection (b), is further amended by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51908CF2DDED499DA2B8FBA18CE78457"><subsection id="id885ac5c64cab41b4a836a215f62773d9"><enum>(d)</enum><text>The Secretary shall develop a Disability Benefits Questionnaire (DBQ), or successor questionnaire, such that if a Persian Gulf veteran presents with any one symptom associated with Gulf War Illness, use of such questionnaire is mandatory for health care personnel of the Department for the identification of Gulf War Illness.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idC02AC77DB08C4154AD86743857397AA0"><enum>(d)</enum><header>Expansion of definition of Persian Gulf veteran</header><text>Subsection (f) of such section is amended by inserting <quote>, Afghanistan, Israel, Egypt, Turkey, Syria, or Jordan</quote> after <quote>operations</quote>.</text></subsection><subsection id="id59C2EC8F37A84A6FBC7D3BFBDE5AE48A"><enum>(e)</enum><header>Training</header><text>Such section is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id97016E0857E74D729B381D231F5AC65B"><subsection id="id5E71821DD3C344978DA286E730134492"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idEB9C095EEEF14434BC829BC147A85F39"><enum>(1)</enum><text>The Secretary shall take such actions as may be necessary to ensure that health care personnel of the Department are appropriately trained to effectively carry out this section.</text></paragraph><paragraph id="id1359DF1325214C04A90A3E5F07955FCF" indent="up1"><enum>(2)</enum><text>Not less frequently than once each year, the Secretary shall submit to Congress a report on the actions taken by the Secretary to carry out paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill> |
