which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220913">September 13, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, to create a presumption that a disability or death of a Federal employee in fire protection activities caused by any of certain diseases is the result of the performance of such employees duty, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6F5889FAADF04070880BAA05C8E92AB2"><section section-type="section-one" id="H2C38543763CB4CCFAFD4EAEFE333C615" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Firefighters Fairness Act of 2021</short-title></quote>.</text></section><section id="H88ECBD78AB2346959CAC4233E91DC252" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Certain diseases presumed to be work-related cause of disability or death for Federal employees in fire protection activities</header><subsection id="HB0D1B2AA40FC4DCDA72BACF137D1D266"><enum>(a)</enum><header>Definition</header><text>Section 8101 of title 5, United States Code, is amended—</text><paragraph id="H732179BE23474BFD97C403CDF01059BA"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (19);</text></paragraph><paragraph id="HB41439BDA0894D268FD868B48FE812CD"><enum>(2)</enum><text>by striking the period at the end of paragraph (20) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HB856B92DB2C047A88710483ED3661813"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H38A2E8EF0D67486281D94FB48F727CB7" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="HFC3BB3D1136342F89C6B86272B286717" indent="down1"><enum>(21)</enum><text><quote>employee in fire protection activities</quote> means a firefighter, paramedic, emergency medical technician, rescue worker, ambulance personnel, or hazardous material worker, who—</text><subparagraph id="HBA7F36CFC91346F4A1E61F39AA58B635"><enum>(A)</enum><text>is trained in fire suppression;</text></subparagraph><subparagraph id="H9E1B0FFBF2154929AF3BC38AA6F58924"><enum>(B)</enum><text>has the legal authority and responsibility to engage in fire suppression;</text></subparagraph><subparagraph id="H2D891CF0CE624728B009481CECAD7F1C"><enum>(C)</enum><text>is engaged in the prevention, control, and extinguishment of fires or response to emergency situations where life, property, or the environment is at risk; and</text></subparagraph><subparagraph id="H7B62A932940845D2B3C30279C1488F12"><enum>(D)</enum><text>performs such activities as a primary responsibility of his or her job.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H36AE50059AF54ECB837595B8EC1D5DB6"><enum>(b)</enum><header>Presumption relating to employees in fire protection activities</header><text>Section 8102 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HF8BCCAA0650A4DD3A5B6E733CFE130D7" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="HB438A4EC4E384233BDB345C9E4E0DFC6"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB24CC234B4F54FFAB0603CD6BCF319BF"><enum>(1)</enum><text>With regard to an employee in fire protection activities, a disease specified in paragraph (3) shall be presumed to be proximately caused by the employment of such employee, subject to the length of service requirements specified. The disability or death of an employee in fire protection activities due to such a disease shall be presumed to result from personal injury sustained while in the performance of such employee’s duty. Such presumptions may be rebutted by a preponderance of the evidence from the employing agency.</text></paragraph><paragraph id="HCBD25D1ED97C4EAAA241FA389BA49B0B" indent="up1"><enum>(2)</enum><text>Such presumptions apply only if the employee in fire protection activities is diagnosed with the disease for which presumption is sought within 10 years of the last active date of employment as an employee in fire protection activities.</text></paragraph><paragraph id="H87C6B6A81EAB44CE8593CB26D093D236" indent="up1"><enum>(3)</enum><text>The following diseases shall be presumed to be proximately caused by the employment of the employee in fire protection activities:</text><subparagraph id="HF6BC5C0AB2A640F0A8F8C62AE7893DE0"><enum>(A)</enum><text>If the employee has been employed for a minimum of 5 years in aggregate as an employee in fire protection activities:</text><clause id="HD65B0D114DD1422B82947E1B1D1C2523"><enum>(i)</enum><text>Heart disease.</text></clause><clause id="H0A4310BABE3A4627B82A1DF35E4B87D0"><enum>(ii)</enum><text>Lung disease.</text></clause><clause id="H9F365DCC6B4641EEA9AA9F5440E2BB5F"><enum>(iii)</enum><text>The following cancers:</text><subclause id="H041548310A78475BA02ACF325B6C8D61"><enum>(I)</enum><text>Brain cancer.</text></subclause><subclause id="H2D8AD1561DAF473EA7E542974982961C"><enum>(II)</enum><text>Cancer of the blood or lymphatic systems.</text></subclause><subclause id="HF971A91A530E4FE88839AA15ABA67C47"><enum>(III)</enum><text>Bladder cancer.</text></subclause><subclause id="HBDE85062D0474BCD8FD753D3000EDD55"><enum>(IV)</enum><text>Kidney cancer.</text></subclause><subclause id="HE5132BCA4ADA435ABCCFDB168D465481"><enum>(V)</enum><text>Testicular cancer.</text></subclause><subclause id="H733A60411C4A41DA89BE68638ABCDE1C"><enum>(VI)</enum><text>Cancer of the digestive system.</text></subclause><subclause id="H64F2AEF5AFE44FCEA8E9D20461750C66"><enum>(VII)</enum><text>Skin cancer.</text></subclause><subclause id="H3C500A3F96344073B8F470D0D96D3E62"><enum>(VIII)</enum><text>Cancer of the respiratory system.</text></subclause><subclause id="HDCAC9104348E4947A87F1378B0C57E4D"><enum>(IX)</enum><text>Breast cancer.</text></subclause></clause><clause id="HCE32709022824F8A8C2C0AC292E2A5CF"><enum>(iv)</enum><text>Any other cancer the contraction of which the Secretary of Labor through regulations determines to be related to the hazards to which an employee in fire protection activities may be subject.</text></clause></subparagraph><subparagraph id="HA0F0BD4A91CF4DDBAE0375DF6AF26744"><enum>(B)</enum><text>Regardless of the length of time an employee in fire protection activities has been employed, any communicable disease that has been determined to be a pandemic by the World Health Organization or the United States Centers for Disease Control and Prevention, or any chronic infectious disease, the contraction of which the Secretary of Labor through regulations determines to be related to the hazards to which an employee in fire protection activities may be subject.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2C615CC4BF0D45D1B7B5E6F391706934"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to a covered disability or death that occurs on or after the date of the enactment of this Act.</text></subsection></section></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section id="H70F19E8BF08343F4B1DA04CC1895E3E5" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Firefighters Fairness Act of 2022</short-title></quote>.</text></section><section id="HFD66AFF8F5A14C9E81CD247AAEE827D1" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Certain illnesses and diseases presumed to be work-related cause of disability or death for Federal employees in fire protection activities</header><subsection id="HF4B9B3A58B6547C9AEDCF8B14B6A621B"><enum>(a)</enum><header>Presumption relating to employees in fire protection activities</header><paragraph id="idE166AFF7FBD5460086FEF55E5D37BDA3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/8143a">section 8143a</external-xref> the following:</text><quoted-block style="USC" id="H67724DDC456147D19934BD4852328CED" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="SSGA00"><section id="HFF47F23E7021415D8789232735E11EA3"><enum>8143b.</enum><header>Employees in fire protection activities</header><subsection id="HB3BECD513462459B8E1616B352EB74DD"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HD822FC214F8D420CA4CA73A213C48FDE"><enum>(1)</enum><header>Employee in fire protection activities</header><text>The term <term>employee in fire protection activities</term> means an employee employed as a firefighter, paramedic, emergency medical technician, rescue worker, ambulance personnel, or hazardous material worker who—</text><subparagraph id="H7C3124D83104413BA24767C7F65EB028"><enum>(A)</enum><text>is trained in fire suppression;</text></subparagraph><subparagraph id="H614C7ECE1B304FD1B499C7A5CB8E6119"><enum>(B)</enum><text>has the legal authority and responsibility to engage in fire suppression;</text></subparagraph><subparagraph id="H2F4001F5347F42B1A086F9966C865E7A"><enum>(C)</enum><text display-inline="yes-display-inline">is engaged in the prevention, control, and extinguishment of fires or response to emergency situations in which life, property, or the environment is at risk, including the prevention, control, suppression, or management of wildland fires; and</text></subparagraph><subparagraph id="HA78D13545C404728BD9F42C150C4D574"><enum>(D)</enum><text>performs the activities described in subparagraph (C) as a primary responsibility of the job of the employee. </text></subparagraph></paragraph><paragraph id="idF0E27F5DADD14FDA897B21A31F9DACDA"><enum>(2)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning given the term in section 804.</text></paragraph><paragraph id="idE3890622210249B08A7116F17CBFFDC3"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph></subsection><subsection id="idE6B058120DDE476EA2524836F1049942"><enum>(b)</enum><header>Certain illnesses and diseases deemed to be proximately caused by employment in fire protection activities</header><paragraph commented="no" display-inline="no-display-inline" id="H0B74380524C44D66858BB9D348BA7FCF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For a claim under this subchapter of disability or death of an employee who has been employed for not less than 5 years in aggregate as an employee in fire protection activities, an illness or disease specified on the list established under paragraph (2) shall be deemed to be proximately caused by the employment of that employee, if the employee is diagnosed with that illness or disease not later than 10 years after the last active date of employment as an employee in fire protection activities.</text></paragraph><paragraph id="H6D1468B988C94990942762C2DF90B573"><enum>(2)</enum><header>Establishment of initial list</header><text display-inline="yes-display-inline">There is established under this section the following list of illnesses and diseases:</text><subparagraph id="HF7CB1EF1EE8F45B693AA3ECB3E246DFB"><enum>(A)</enum><text>Bladder cancer.</text></subparagraph><subparagraph id="H800DC09CB9564821BCE42F370D613CDD" display-inline="no-display-inline"><enum>(B)</enum><text>Brain cancer.</text></subparagraph><subparagraph id="H67137D3DCBE445F9A37FC9F3A250B738"><enum>(C)</enum><text display-inline="yes-display-inline">Chronic obstructive pulmonary disease.</text></subparagraph><subparagraph id="H84D2AB3630D445068D33C84C9971510E"><enum>(D)</enum><text display-inline="yes-display-inline">Colorectal cancer.</text></subparagraph><subparagraph id="HC6C9402CA6024B8DAC9B49BFE2FC4B98"><enum>(E)</enum><text display-inline="yes-display-inline">Esophageal cancer.</text></subparagraph><subparagraph id="H686E3282D94846699194E99B72702523"><enum>(F)</enum><text>Kidney cancer.</text></subparagraph><subparagraph id="HC616D67D7AEF428DB162D3BBD1CEF676"><enum>(G)</enum><text display-inline="yes-display-inline">Leukemias.</text></subparagraph><subparagraph id="HFBAF3AB09663419CA955FFF2EFEC231B"><enum>(H)</enum><text display-inline="yes-display-inline">Lung cancer.</text></subparagraph><subparagraph id="H80FBAE28AE7F403C9964E39BB38DDA5E"><enum>(I)</enum><text display-inline="yes-display-inline">Mesothelioma.</text></subparagraph><subparagraph id="HE0D5CF7830A04E76A091CBEAD8DB8DF1"><enum>(J)</enum><text display-inline="yes-display-inline">Multiple myeloma.</text></subparagraph><subparagraph id="H74B32400544A4C129904B081766C5095"><enum>(K)</enum><text display-inline="yes-display-inline">Non-Hodgkin lymphoma.</text></subparagraph><subparagraph id="HF1828F7FAB184B4497DD82BC21583B19"><enum>(L)</enum><text display-inline="yes-display-inline">Prostate cancer.</text></subparagraph><subparagraph id="H725264484E8B4DB394B300743CE2D984"><enum>(M)</enum><text>Skin cancer (melanoma).</text></subparagraph><subparagraph id="HE5261F4C5F4F498596E97A98BBFD4C25"><enum>(N)</enum><text display-inline="yes-display-inline">A sudden cardiac event or stroke suffered while, or not later than 24 hours after, engaging in the activities described in subsection (a)(1)(C).</text></subparagraph><subparagraph id="HE743347B2E42440593AB75EDA26A734F"><enum>(O)</enum><text>Testicular cancer.</text></subparagraph><subparagraph id="HBE45A31CBE414F17A83E1FDF1E40A39B"><enum>(P)</enum><text display-inline="yes-display-inline">Thyroid cancer.</text></subparagraph></paragraph><paragraph id="HE6D5D2A81DD148C0A3C3BE2AA12C3879"><enum>(3)</enum><header>Additions to the list</header><subparagraph id="HE3A30EBC9E58409FADA04364435F2F50"><enum>(A)</enum><header>In general</header><clause id="idE497A3059F044A00B32306A88D78C0C4"><enum>(i)</enum><header>Periodic review</header><text display-inline="yes-display-inline">The Secretary shall— </text><subclause id="idA77A89775A3E4EF4B103BC88C460DBCA"><enum>(I)</enum><text display-inline="yes-display-inline">in consultation with the Director of the National Institute for Occupational Safety and Health and any advisory committee determined appropriate by the Secretary, periodically review the list established under paragraph (2); and </text></subclause><subclause id="idAC7B7EAAB89D4705B589EC3A6640CA1D"><enum>(II)</enum><text display-inline="yes-display-inline">if the Secretary determines that the weight of the best available scientific evidence warrants adding an illness or disease to the list established under paragraph (2), as described in subparagraph (B) of this paragraph, make such an addition through a rule that clearly identifies that scientific evidence.</text></subclause></clause><clause id="idCABDD2B3006442E08FD33BB284774052"><enum>(ii)</enum><header>Classification</header><text>A rule issued by the Secretary under clause (i) shall be considered to be a major rule for the purposes of chapter 8.</text></clause></subparagraph><subparagraph id="H54371233BA6D4514A2153000E0528F28"><enum>(B)</enum><header>Basis for determination</header><text>The Secretary shall add an illness or disease to the list established under paragraph (2) based on the weight of the best available scientific evidence that there is a significant risk to employees in fire protection activities of developing that illness or disease.</text></subparagraph><subparagraph id="H630DB8A276164217A27B0C13A9D227C8"><enum>(C)</enum><header>Available expertise</header><text>In determining significant risk for purposes of subparagraph (B), the Secretary may accept as authoritative, and may rely upon, recommendations, risk assessments, and scientific studies (including analyses of National Firefighter Registry data pertaining to Federal firefighters) by the National Institute for Occupational Safety and Health, the National Toxicology Program, the National Academies of Sciences, Engineering, and Medicine, and the International Agency for Research on Cancer.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id65DB9386F280473DB7B388E44AD7818E"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/8143a">section 8143a</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE47382F51FCC4215A35A5580955392DB" changed="added" reported-display-style="italic" committee-id="SSGA00"><toc changed="added" reported-display-style="italic" committee-id="SSGA00"><toc-entry level="section" bold="off">8143b. Employees in fire protection activities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE5D8A4B5742F470C80A0BE8FACD9A7A6"><enum>(3)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to claims for compensation filed on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H2520F5BCE2CC4A65BCB393D78A7362C8"><enum>(b)</enum><header>Research cooperation</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of Labor (referred to in this section as the <quote>Secretary</quote>) shall establish a process by which an employee in fire protection activities, as defined in subsection (a) of section 8143b of title 5, United States Code, as added by subsection (a) of this section (referred to in this section as an <quote>employee in fire protection activities</quote>), filing a claim under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, as amended by this Act, relating to an illness or disease on the list established under subsection (b)(2) of such section 8143b (referred to in this section as <quote>the list</quote>), as the list may be updated under such section 8143b, shall be informed about, and offered the opportunity to contribute to science by voluntarily enrolling in, the National Firefighter Registry or a similar research or public health initiative conducted by the Centers for Disease Control and Prevention.</text></subsection><subsection id="HB00CC180E4E64A89BEB9E854B5194E5C"><enum>(c)</enum><header>Agenda for Further Review</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Secretary shall—</text><paragraph id="HAED39F6BCA20466482F4C1B16D147E6C"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the best available scientific evidence of the risk to an employee in fire protection activities of developing breast cancer, gynecological cancers, and rhabdomyolysis;</text></paragraph><paragraph id="H5AD92C0C02784C63A3C5A85C483D4259"><enum>(2)</enum><text display-inline="yes-display-inline">add breast cancer, gynecological cancers, and rhabdomyolysis to the list, by rule in accordance with subsection (b)(3) of section 8143b of title 5, United States Code, as added by subsection (a) of this section, if the Secretary determines that such evidence supports that addition; and</text></paragraph><paragraph id="H47B9D6D772924878B8DC320E112F7AD5"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Education and Labor of the House of Representatives a report containing— </text><subparagraph id="idD3CDA4DC655A43ACA5D81D9251103638"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the Secretary after making the evaluation required under paragraph (1); and </text></subparagraph><subparagraph id="id34564F728B7B42509421FD431C2B219B"><enum>(B)</enum><text display-inline="yes-display-inline">the determination of the Secretary under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="H621C3D81A49149E89C335B6BC7A9D388"><enum>(d)</enum><header>Report on Federal wildland firefighters</header><paragraph id="idD0FA9CFA150F4F75A05284F5F8454E0D"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>Federal wildland firefighter</term> means an individual occupying a position in the occupational series developed pursuant to section 40803(d)(1) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(1)</external-xref>). </text></paragraph><paragraph id="id4A8701B805C1417CB0BDE913808D840E"><enum>(2)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture, in consultation with the Director of the National Institute for Occupational Safety and Health, shall conduct a comprehensive study on long-term health effects that Federal wildland firefighters who are eligible to receive compensation for work injuries under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, as amended by this Act, experience after being exposed to fires, smoke, and toxic fumes when in service. </text></paragraph><paragraph id="idA28B4E7DE0D842868F0EFA19E5605857"><enum>(3)</enum><header>Requirements</header><text display-inline="yes-display-inline">The study required under paragraph (2) shall include—</text><subparagraph id="HE0EB0E0CEEE2427FBE998DD52CBD48C7"><enum>(A)</enum><text>the race, ethnicity, age, gender, and time of service of the Federal wildland firefighters participating in the study; and</text></subparagraph><subparagraph id="H65214D58EA5648D295C77778BC0AE1D9"><enum>(B)</enum><text>recommendations to Congress regarding what legislative actions are needed to support the Federal wildland firefighters described in subparagraph (A) in preventing health issues from the toxic exposure described in paragraph (2), similar to veterans who are exposed to burn pits.</text></subparagraph></paragraph><paragraph id="id0C1BA7DCFEAF4A3ABBB713375D5EF4A1"><enum>(4)</enum><header>Submission and publication</header><text>The Secretary of the Interior and the Secretary of Agriculture shall submit the results of the study conducted under this subsection to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Education and Labor of the House of Representatives and make those results publicly available. </text></paragraph></subsection><subsection id="H301ED17BBB25489686B5BC5A16331FC5"><enum>(e)</enum><header>Report on affected employees</header><text display-inline="yes-display-inline">Beginning on the date that is 1 year after the date of enactment of this Act, with respect to each annual report required under section 8152 of title 5, United States Code, the Secretary— </text><paragraph id="idB3E1BA26BB9C4E4593C3C4A9A3C8B50A"><enum>(1)</enum><text display-inline="yes-display-inline">shall include in the report the total number of, and demographics regarding, employees in fire protection activities with illnesses and diseases described in the list (as the list may be updated under this Act and the amendments made by this Act), as of the date on which that annual report is submitted, which shall be disaggregated by the specific illness or disease for the purposes of understanding the scope of the problem facing those employees; and</text></paragraph><paragraph id="id5477643F4C2A44E6A6DEFD4E4ED7FB02"><enum>(2)</enum><text display-inline="yes-display-inline">may— </text><subparagraph id="id3807A89A1CAD4B37B98CA50534D5E4E5"><enum>(A)</enum><text display-inline="yes-display-inline">include in the report any information with respect to employees in fire protection activities that the Secretary determines to be necessary; and </text></subparagraph><subparagraph id="id78B536A956BD4E0B9C3F9E7D5D50DCC7"><enum>(B)</enum><text display-inline="yes-display-inline">as appropriate, make recommendations in the report for additional actions that could be taken to minimize the risk of adverse health impacts for employees in fire protection activities.</text></subparagraph></paragraph></subsection></section><section id="H030EB2D51D294B969F0403952D094B4B" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Increase in time-period for FECA claimant to supply supporting documentation to Office of Worker’s Compensation</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Labor shall—</text><paragraph id="HC7136D23949244CC84EE241259F5B7D8"><enum>(1)</enum><text>amend section 10.121 of title 20, Code of Federal Regulations, or any successor regulation, by striking <quote>30 days</quote> and inserting <quote>60 days</quote>; and</text></paragraph><paragraph id="H94F7B44339A24A128E635A4542B433FB"><enum>(2)</enum><text>modify the Federal Employees’ Compensation Act manual to reflect the changes made by the Secretary pursuant to paragraph (1).</text></paragraph></section></legis-body><endorsement><action-date date="20220913">September 13, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
