committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make PPE in America Act</short-title></quote>.</text></section><section id="id17ef1dc247ee41a2a49ff18cce3e6b7d" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="idf9860c8979a14360857b18d2530b3114"><enum>(1)</enum><text>The COVID–19 pandemic has exposed the vulnerability of the United States supply chains for, and lack of domestic production of, personal protective equipment (PPE).</text></paragraph><paragraph id="id4f0c7d11cf824c92a1f44c689c4fe6e7"><enum>(2)</enum><text>The United States requires a robust, secure, and wholly domestic PPE supply chain to safeguard public health and national security.</text></paragraph><paragraph id="id8efece76cd2f49efa08aa36f050bb86e"><enum>(3)</enum><text>Issuing a strategy that provides the government’s anticipated needs over the next three years will enable suppliers to assess what changes, if any, are needed in their manufacturing capacity to meet expected demands. </text></paragraph><paragraph id="idaadd5576db634aa8b7de30d43af9950d"><enum>(4)</enum><text>In order to foster a domestic PPE supply chain, United States industry needs a strong and consistent demand signal from the Federal Government providing the necessary certainty to expand production capacity investment in the United States. </text></paragraph><paragraph id="id52ea6bb609b8490fb010901a8dd3770c"><enum>(5)</enum><text>In order to effectively incentivize investment in the United States and the re-shoring of manufacturing, long-term contracts must be no shorter than three years in duration.</text></paragraph><paragraph id="id4f67acf8b61647ab927f93bb7b12ced7"><enum>(6)</enum><text>The United States needs a long-term investment strategy for the domestic production of PPE items critical to the United States national response to a public health crisis, including the COVID–19 pandemic. </text></paragraph></section><section id="ideb0ca4d0fcf0499194b9f07c73cf72c4" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Requirement of long-term contracts for domestically manufactured personal protective equipment</header><subsection id="idbda0d56ef3754719990c69b783d76e5d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idE2557C1B77A84E06AFABFB2CDD506FE7"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ide64c50dd61ee4ee68c162bf93ae39124"><enum>(A)</enum><text>the Committee on Health, Education, Labor, and Pensions, the Committee on Finance, the Committee on Homeland Security and Governmental Affairs, the Committee on Veterans’ Affairs, and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="id96BBD70246A240BA8DBB5090482FEBBA"><enum>(B)</enum><text>the Committee on Energy and Commerce, the Committee on Ways and Means, the Committee on Homeland Security, the Committee on Veterans’ Affairs, and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id4a1bc789a68d44dba65811c63d0ca284"><enum>(2)</enum><header>Covered Secretary</header><text>The term <term>covered Secretary</term> means the Secretary of Homeland Security, the Secretary of Health and Human Services, the Secretary of Defense, the Secretary of Education, and the Secretary of Veterans Affairs. </text></paragraph><paragraph id="idae4ecb0c379c442a9a012aec14de9f52"><enum>(3)</enum><header>Personal protective equipment</header><text>The term <term>personal protective equipment</term> means surgical masks, respirator masks and powered air purifying respirators and required filters, face shields and protective eyewear, gloves, disposable and reusable surgical and isolation gowns, and head and foot coverings, or other gear or clothing used to protect an individual from the transmission of disease.</text></paragraph><paragraph id="id132f0caec3a24856a0988fe99d9e3558"><enum>(4)</enum><header>United States</header><text>The term <term>United States</term> means the 50 States, the District of Columbia, and the possessions of the United States.</text></paragraph></subsection><subsection id="id4eb99110e0cb45c3b7245d1c655414c5"><enum>(b)</enum><header>Contract requirements</header><text>Beginning 90 days after the date of the enactment of this Act, in order to ensure the sustainment and expansion of personal protective equipment manufacturing in the United States and meet the needs of the current pandemic response, any contract for the procurement of personal protective equipment entered into by a covered Secretary, or a covered Secretary's designee, shall—</text><paragraph id="id5202c28c61ab4a6993e4cd55c8843286"><enum>(1)</enum><text>be issued for a duration of at least 3 years, including a base period and all option periods, to incentivize investment in the production of personal protective equipment and the materials and components thereof in the United States; and </text></paragraph><paragraph id="idd41c561881a04543bdae211a3aede892"><enum>(2)</enum><text>be for personal protective equipment that—</text><subparagraph id="id88C3027C13C84749B779335C5454278C"><enum>(A)</enum><text>is grown, reprocessed, reused, or produced in the United States; and</text></subparagraph><subparagraph id="id1C2B1FE90DBE4E4E830F2B924D3AF600"><enum>(B)</enum><text>when assembled outside the United States, contains only materials and components that are grown, reprocessed, reused, or produced in the United States. </text></subparagraph></paragraph></subsection><subsection id="id0a2788cb1b224951872126814e73dceb"><enum>(c)</enum><header>Availability exception</header><text>Paragraph (2) of subsection (b) shall not apply to an item of personal protective equipment, or component or material thereof—</text><paragraph id="id3dc5dd596d73431b8a4997e378072812"><enum>(1)</enum><text>that is, or that includes, a material listed in section 25.104 of the Federal Acquisition Regulation as one for which a non-availability determination has been made;</text></paragraph><paragraph id="id073e84ae50e747a7a852a5eac708313d"><enum>(2)</enum><text>as to which the covered Secretary determines that a sufficient quantity of a satisfactory quality that is grown, reprocessed, reused, or produced in the United States cannot be procured as, and when, needed at United States market prices; or</text></paragraph><paragraph id="id3d3b8a5e2c4f40e49b396dfc916200d6"><enum>(3)</enum><text>if, after maximizing to the extent feasible sources consistent with subsection (b), the covered Secretary certifies every 120 days that it is necessary to procure personal protective equipment under alternate procedures to respond to the immediate needs of a public health emergency. </text></paragraph></subsection><subsection id="idF97467E4F7CD45DFB3031705CB6096F3"><enum>(d)</enum><header>Report</header><paragraph id="id005385F6D5944829A36D41947193AB1E"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of the Office of Management and Budget, in consultation with the covered Secretaries, shall submit to the chairs and ranking members of the appropriate congressional committees a report on the procurement of personal protective equipment.</text></paragraph><paragraph id="idD1018B1CB49C4878A4EF50C68BC606D6"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall include the following elements:</text><subparagraph id="id3c80a29360e543ceabcb48955bb882e4"><enum>(A)</enum><text>The United States long-term domestic procurement strategy for PPE produced in the United States, including strategies to incentivize investment in and maintain United States supply chains for all PPE sufficient to meet the needs of the United States during a public health emergency.</text></subparagraph><subparagraph id="idDF5DA0ED30A64EDB8600391569CBDB57"><enum>(B)</enum><text>An estimate of long-term demand quantities for all PPE items procured by the United States.</text></subparagraph><subparagraph id="id81ef1ecdff064d56937f76b96cb9b053"><enum>(C)</enum><text>Recommendations for congressional action required to implement the United States Government's procurement strategy.</text></subparagraph><subparagraph id="iddb2ccdd1e8d946f28d73b2dfef9a971a"><enum>(D)</enum><text>A determination whether all notifications, amendments, and other necessary actions have been completed to bring the United States existing international obligations into conformity with the statutory requirements of this Act. </text></subparagraph></paragraph></subsection><subsection id="id2AFDDA072ABB4568AD47FCD68F5793D8"><enum>(e)</enum><header>Authorization of transfer of equipment</header><text>A covered Secretary may transfer to the Strategic National Stockpile established under section 319F–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6b">42 U.S.C. 247d–6b</external-xref>) any excess personal protective equipment acquired under a contract executed pursuant to subsection (b). </text></subsection><subsection id="id33DECF77780F434784CA2B2C8CE31409"><enum>(f)</enum><header>Compliance with international agreements</header><text>This Act shall be applied in a manner consistent with United States obligations under international agreements. </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id6bcf03b3-851b-4fec-b952-35251b10da13" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make PPE in America Act</short-title></quote>.</text></section><section id="id0354e54d-e642-416c-9d36-d2731523c4c3" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id4c0b9ad2-4025-49b8-a2c7-3b29b5a6f3a5"><enum>(1)</enum><text>The COVID–19 pandemic has exposed the vulnerability of the United States supply chains for, and lack of domestic production of, personal protective equipment (PPE).</text></paragraph><paragraph id="id535bced3-0429-4fb5-9362-cacb240e4255"><enum>(2)</enum><text>The United States requires a robust, secure, and wholly domestic PPE supply chain to safeguard public health and national security.</text></paragraph><paragraph id="idd49c50cb-0299-403c-b959-b2823189dd0d"><enum>(3)</enum><text>Issuing a strategy that provides the government’s anticipated needs over the next three years will enable suppliers to assess what changes, if any, are needed in their manufacturing capacity to meet expected demands. </text></paragraph><paragraph id="id43113952-8bda-47c0-956f-e4ec1eab23b1"><enum>(4)</enum><text>In order to foster a domestic PPE supply chain, United States industry needs a strong and consistent demand signal from the Federal Government providing the necessary certainty to expand production capacity investment in the United States. </text></paragraph><paragraph id="id8bc24f8b-3bcd-4f8a-89d0-fcc601ac7f69"><enum>(5)</enum><text>In order to effectively incentivize investment in the United States and the re-shoring of manufacturing, long-term contracts must be no shorter than three years in duration.</text></paragraph><paragraph id="idC59E9A56CB1F49E0B1F357307A2D8E4A"><enum>(6)</enum><text>To accomplish this aim, the United States should seek to ensure compliance with its international obligations, such as its commitments under the World Trade Organization’s Agreement on Government Procurement and its free trade agreements, including by invoking any relevant exceptions to those agreements, especially those related to national security and public health.</text></paragraph><paragraph id="id4b6f81c9-5b6f-4289-8f91-e935d4a02136"><enum>(7)</enum><text>The United States needs a long-term investment strategy for the domestic production of PPE items critical to the United States national response to a public health crisis, including the COVID–19 pandemic. </text></paragraph></section><section id="id4475721b-94d9-4a67-a4ad-f66d5efbe8c6" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Requirement of long-term contracts for domestically manufactured personal protective equipment</header><subsection id="id62939942-d3ee-47db-819b-49ba96343992"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd2bd44e5-94d4-480a-929e-b7cc1141a78b"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id384e87cf-ad6a-450a-82e3-311f92a736f9"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs, the Committee on Health, Education, Labor, and Pensions, the Committee on Finance, the Committee on Veterans’ Affairs, and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="idcb91dbb0-e58c-414d-925f-48f30319a499"><enum>(B)</enum><text> the Committee on Homeland Security, the Committee on Oversight, the Committee on Energy and Commerce, the Committee on Ways and Means, the Committee on Veterans’ Affairs, and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id0c0349cf-00fb-4e8c-81bf-ae03925355ad"><enum>(2)</enum><header>Covered Secretary</header><text>The term <term>covered Secretary</term> means the Secretary of Homeland Security, the Secretary of Health and Human Services, the Secretary of Defense, and the Secretary of Veterans Affairs. </text></paragraph><paragraph id="id04496162-15a9-4d8e-970d-1810fc6dd067"><enum>(3)</enum><header>Personal protective equipment</header><text>The term <term>personal protective equipment</term> means surgical masks, respirator masks and powered air purifying respirators and required filters, face shields and protective eyewear, gloves, disposable and reusable surgical and isolation gowns, head and foot coverings, and other gear or clothing used to protect an individual from the transmission of disease.</text></paragraph><paragraph id="idcbfd6325-1544-40ec-bec2-5ef4a843627f"><enum>(4)</enum><header>United States</header><text>The term <term>United States</term> means the 50 States, the District of Columbia, and the possessions of the United States.</text></paragraph></subsection><subsection id="idc73ba26a-4778-4274-986a-c98f2256d832"><enum>(b)</enum><header>Contract requirements for domestic production</header><text>Beginning 90 days after the date of the enactment of this Act, in order to ensure the sustainment and expansion of personal protective equipment manufacturing in the United States and meet the needs of the current pandemic response, any contract for the procurement of personal protective equipment entered into by a covered Secretary, or a covered Secretary's designee, shall—</text><paragraph id="idf9bfa754-42ac-4932-9b9d-c27a5e2d08be"><enum>(1)</enum><text>be issued for a duration of at least 2 years, plus all option periods necessary, to incentivize investment in the production of personal protective equipment and the materials and components thereof in the United States; and </text></paragraph><paragraph id="id430002d9f489424899889678f86831b4"><enum>(2)</enum><text>be for personal protective equipment, including the materials and components thereof, that is grown, reprocessed, reused, or produced in the United States. </text></paragraph></subsection><subsection id="idEF43B02037F943A39FC1639C40089ED3"><enum>(c)</enum><header>Alternatives to domestic production</header><text>The requirement under subsection (b) shall not apply to an item of personal protective equipment, or component or material thereof if, after maximizing to the extent feasible sources consistent with subsection (b), the covered Secretary—</text><paragraph id="id176b4b8662244437a2466e04659374c3"><enum>(1)</enum><text>maximizes sources for personal protective equipment that is assembled outside the United States containing only materials and components that are grown, reprocessed, reused, or produced in the United States; and</text></paragraph><paragraph id="idc5c42aa56e2d4df0b9d209a3e9581dca"><enum>(2)</enum><text>certifies every 120 days that it is necessary to procure personal protective equipment under alternative procedures to respond to the immediate needs of a public health emergency. </text></paragraph></subsection><subsection id="id74de4002-d185-42fa-88f9-839ed74425ec" commented="no"><enum>(d)</enum><header>Availability exception</header><paragraph id="id149E697BF1864838A7CE4C4623C9D8A6" commented="no"><enum>(1)</enum><header>In general</header><text>Subsections (b) and (c) shall not apply to an item of personal protective equipment, or component or material thereof—</text><subparagraph id="idc5961b21-73c9-40a6-9add-4d25e11e5b69" commented="no"><enum>(A)</enum><text>that is, or that includes, a material listed in section 25.104 of the Federal Acquisition Regulation as one for which a non-availability determination has been made; or</text></subparagraph><subparagraph id="id56b5588a-1d6c-4e73-bd5e-9c4a0fe247d8" commented="no"><enum>(B)</enum><text>as to which the covered Secretary determines that a sufficient quantity of a satisfactory quality that is grown, reprocessed, reused, or produced in the United States cannot be procured as, and when, needed at United States market prices.</text></subparagraph></paragraph><paragraph id="idF87B1F4301FA4F04A620D4E9353385D7" commented="no"><enum>(2)</enum><header>Certification requirement</header><text>The covered Secretary shall certify every 120 days that the exception under paragraph (1) is necessary to meet the immediate needs of a public health emergency.</text></paragraph></subsection><subsection id="ida615c551-409a-42d3-8793-a60c4b6c980c"><enum>(e)</enum><header>Report</header><paragraph id="id9ec0cc7c-eac5-4fef-b102-ebea537026f2"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget, in consultation with the covered Secretaries, shall submit to the chairs and ranking members of the appropriate congressional committees a report on the procurement of personal protective equipment.</text></paragraph><paragraph id="ideea46a36-9be4-47d8-9955-0dbe0af88df8"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall include the following elements:</text><subparagraph id="id608f4b36-5ded-4f6c-83b8-7d49eb026263"><enum>(A)</enum><text>The United States long-term domestic procurement strategy for PPE produced in the United States, including strategies to incentivize investment in and maintain United States supply chains for all PPE sufficient to meet the needs of the United States during a public health emergency.</text></subparagraph><subparagraph id="id1A47414C690D4743BD601DFE43FB7EBE"><enum>(f)</enum><header>Authorization of transfer of equipment</header><paragraph id="idFD770958F57A4737ADF4AF4FCB3743B6"><enum>(1)</enum><header>In general</header><text>A covered Secretary may transfer to the Strategic National Stockpile established under section 319F–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6b">42 U.S.C. 247d–6b</external-xref>) any excess personal protective equipment acquired under a contract executed pursuant to subsection (b). </text></paragraph><paragraph id="id64784989-aa45-46a4-a127-2f5ad4ed6872"><enum>(2)</enum><header>Transfer of equipment during a public health emergency</header><subparagraph id="idb1819c4c-1e06-40cd-9d15-8fdeb07cc4a3"><enum>(A)</enum><header>Amendment</header><text>Title V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9286b9d6-2701-4f57-998a-1a0ac0d506cc" changed="not-changed"><section id="idf6e31352-2051-4e75-b5a5-dbee89dd94eb" changed="added" committee-id="SSGA00" reported-display-style="italic"><enum>529.</enum><header>Transfer of equipment during a public health emergency</header><subsection id="idfa21bbc0-878a-4069-a2e6-7b633a47da3e"><enum>(a)</enum><header>Authorization of transfer of equipment</header><text>During a public health emergency declared by the Secretary of Health and Human Services under section 319(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d(a)</external-xref>), the Secretary, at the request of the Secretary of Health and Human Services, may transfer to the Department of Health and Human Services, on a reimbursable basis, excess personal protective equipment or medically necessary equipment in the possession of the Department. </text></subsection><subsection id="id21d02dc4-29d7-45d2-84f2-20327758bb4c"><enum>(b)</enum><header>Determination by Secretaries</header><paragraph id="idde4b601e-cb42-4f90-b5c1-486721807f48"><enum>(1)</enum><header>In general</header><text>In carrying out this section—</text><subparagraph id="id7838cace-6e8a-4ab7-844b-d07a385248e8"><enum>(A)</enum><text>before requesting a transfer under subsection (a), the Secretary of Health and Human Services shall determine whether the personal protective equipment or medically necessary equipment is otherwise available; and</text></subparagraph><subparagraph id="id4912C7BE19D3430DA8293A3650D04F3D"><enum>(B)</enum><text>before initiating a transfer under subsection (a), the Secretary, in consultation with the heads of each component within the Department, shall—</text><clause id="id284bc4e3-9628-4f9c-96f5-408ed268cee4"><enum>(i)</enum><text>determine whether the personal protective equipment or medically necessary equipment requested to be transferred under subsection (a) is excess equipment; and</text></clause><clause id="id6C2DD61BF9904951B9AC5F6E0125E08C"><enum>(ii)</enum><text>certify that the transfer of the personal protective equipment or medically necessary equipment will not adversely impact the health or safety of officers, employees, or contractors of the Department. </text></clause></subparagraph></paragraph><paragraph id="id618fa5a1-691f-409d-bd48-b6ebf5510e31"><enum>(2)</enum><header>Notification</header><text>The Secretary of Health and Human Services and the Secretary shall each submit to Congress a notification explaining the determination made under subparagraphs (A) and (B), respectively, of paragraph (1). </text></paragraph><paragraph id="idc421ebdd-98f3-4cb2-bbf2-e90d86b47c6b"><enum>(3)</enum><header>Required inventory</header><subparagraph id="id041C8F327AE44FB2B36E72A2B4F585C3"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text><clause id="id06b49b04-17ad-465c-a4d2-886b1d65ab3e"><enum>(i)</enum><text>acting through the Chief Medical Officer of the Department, maintain an inventory of all personal protective equipment and medically necessary equipment in the possession of the Department; and</text></clause><clause id="idab77b761-a001-4e34-8a1e-d76b6e7dae7e"><enum>(ii)</enum><text>make the inventory required under clause (i) available, on a continual basis, to—</text><subclause id="idb3771036-09ea-4d46-9eb3-7bf743b6254b"><enum>(I)</enum><text>the Secretary of Health and Human Services; and</text></subclause><subclause id="id26a4fb8a-12cb-471e-a2fe-0fd1fe32e210"><enum>(II)</enum><text>the Committee on Appropriations and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Appropriations and the Committee on Homeland Security of the House of Representatives.</text></subclause></clause></subparagraph><subparagraph id="id2816C42ACD0C4C42825969B86485ABEA"><enum>(B)</enum><header>Form</header><text>Each inventory required to be made available under subparagraph (A) shall be submitted in unclassified form, but may include a classified annex.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="idb76e4b9c-a2ae-4c88-9158-be162b6ea739"><enum>(B)</enum><header>Table of contents amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 528 the following:</text><quoted-block style="OLC" id="idb0c914a7-3e19-4848-b742-5cc123bb7de4" changed="not-changed"><toc changed="not-changed"><toc-entry level="section" changed="added" committee-id="SSGA00" reported-display-style="italic">Sec. 529. Transfer of equipment during a public health emergency.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id5043B8C834B04E888EEC725361073B11"><enum>(3)</enum><header>Strategic national stockpile</header><text>Section 319F–2(a) of the Public Health Service Act (42 U.S.C. 247d–6b(a)) is amended by adding at the end the following:</text><quoted-block id="idE7E236A2C9F64429A20706330F1782E0" changed="not-changed" display-inline="no-display-inline" style="OLC"><paragraph id="id228DD4EDA407440CBFE2F3DBDC08A0A7" changed="added" committee-id="SSGA00" reported-display-style="italic"><enum>(6)</enum><header>Transfers of items</header><text>The Secretary, in coordination with the Secretary of Homeland Security, may sell drugs, vaccines and other biological products, medical devices, or other supplies maintained in the stockpile under paragraph (1) to a Federal agency or private, nonprofit, State, local, tribal, or territorial entity for immediate use and distribution, provided that any such items being sold are—</text><subparagraph id="idd4f7bd5a464c4765ba7d4e4591cb8a5b"><enum>(A)</enum><text>within 1 year of their expiration date; or</text></subparagraph><subparagraph id="iddaf3945cdf184231bfa9e2758edd983d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>determined by the Secretary to no longer be needed in the stockpile due to advances in medical or technical capabilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idce98c8f2-05ee-47ab-bbc1-d74ac403e733"><enum>(g)</enum><header>Compliance with international agreements</header><text>The President or the President’s designee shall take all necessary steps, including invoking the rights of the United States under Article III of the World Trade Organization’s Agreement on Government Procurement and the relevant exceptions of other relevant agreements to which the United States is a party, to ensure that the international obligations of the United States are consistent with the provisions of this Act. </text></subsection></section></legis-body><endorsement><action-date date="20221219">December 19, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
