which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>September 27, 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To redesignate the Pullman National Monument in the State of Illinois as the Pullman National Historical Park, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H10961398213043C7A71A77E4E9C7FDC6"><section section-type="section-one" id="HF59927590F0F4B8CAEF165DC69BCAB92"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pullman National Historical Park Act</short-title></quote>.</text></section><section id="H877F4356D10D4908A13178DBF60BEE2F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H6FC6B28D244149D2A0F89CEBE817F67A"><enum>(1)</enum><header>Historical park</header><text>The term <term>historical park</term> means the Pullman National Historical Park.</text></paragraph><paragraph id="H9B9508B4850B4703B58D87214F0CD934" changed="deleted" reported-display-style="strikethrough"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Pullman National Historical Park, Chicago, Illinois, Boundary</quote>, numbered ____, and dated _____.</text></paragraph><paragraph id="idef0c268efd924bf9868a2ed6f3de8413" changed="added" reported-display-style="italic"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Pullman National Historical Park Boundary</quote>, numbered 590/125,485, and dated November 2021. </text></paragraph><paragraph id="H5F8AF02ABA394B0CAB4DCFEED5190DAB"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H6364BEE5D06648338118DEAD312130CE"><enum>3.</enum><header>Redesignation of Pullman National Monument</header><subsection id="H18BDD72E8A784BE5906B4CC2879620C2"><enum>(a)</enum><header>In general</header><text>The Pullman National Monument, established by Proclamation Number 9233, dated February 19, 2015, is redesignated as the <quote>Pullman National Historical Park.</quote>.</text></subsection><subsection id="HB4FB7BD5D41C4EB58BC007DF4E59205F"><enum>(b)</enum><header>Availability of funds</header><text>Any funds available for purposes of the Pullman National Monument shall be available for purposes of the historical park.</text></subsection><subsection id="H60A19576E6534F879D3C884DD0E8A406"><enum>(c)</enum><header>References</header><text>Any references in a law, regulation, document, record, map, or other paper of the United States to the Pullman National Monument shall be considered to be a reference to the historical park.</text></subsection><subsection id="H3CE387E5F7894F8F83FEBC9A4A52B205"><enum>(d)</enum><header>Proclamation</header><text display-inline="yes-display-inline">Proclamation Number 9233, dated February 19, 2015, shall have no force or effect.</text></subsection></section><section id="H9967F2EAC40149369725ECC6AF40D3F3"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the historical park are to preserve, protect, and interpret Pullman’s nationally significant cultural and historical resources associated with—</text><paragraph id="HF9BBDFC1D237438A813DB2D5E671246E"><enum>(1)</enum><text>the Nation’s labor history and creation of a national Labor Day holiday;</text></paragraph><paragraph id="H8CE5DE52CF944C67ABA96B1E844647D9"><enum>(2)</enum><text>the first planned industrial community in the United States;</text></paragraph><paragraph id="HD8C4B5C5B6C84AFF87B3333C4ED82251"><enum>(3)</enum><text>the architecture and landscape design of the planned community;</text></paragraph><paragraph id="H9ECF694AE3914550BC2A4DDB31517AA3"><enum>(4)</enum><text>the pivotal role of the Pullman porter in the rise of the African-American middle class; and</text></paragraph><paragraph id="H3CC921818FD84187945BA889A9F0560A"><enum>(5)</enum><text>the entirety of history, culture, and historic figures embodied in Presidential Proclamation Number 9233.</text></paragraph></section><section id="HFF6FD53F6D6D400E8C824915FADB573B"><enum>5.</enum><header>Administration</header><text display-inline="no-display-inline">The Secretary shall administer the land within the boundary of the historical park in accordance with—</text><paragraph id="H162B1FED256340C8A54FDF79F05715DB"><enum>(1)</enum><text>this Act; and</text></paragraph><paragraph id="H2DC5A88A39B94BE6A87BA246736A6113"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text><subparagraph id="H212CFC87C38849368095876AE986EFA1"><enum>(A)</enum><text display-inline="yes-display-inline">section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753 and 102101 of title 54, United States Code; and</text></subparagraph><subparagraph id="H95B8CF8199EA4941AF50C84028418981"><enum>(B)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3201">chapter 3201</external-xref> of title 54, United States Code.</text></subparagraph></paragraph></section><section id="HAF56F526B00A4A73B94DBFB920CE5ED5"><enum>6.</enum><header>Cooperative agreements</header><text display-inline="no-display-inline">To further the purposes of this subsection and notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">chapter 63</external-xref> of title 31, United States Code, the Secretary may enter into cooperative agreements with the State, other public and non-profit entities, and other interested parties—</text><paragraph id="H3626CD824F04486D98B89FE10C24DDD1"><enum>(1)</enum><text>to support collaborative interpretive and educational programs at non-Federal historic properties within the boundaries of the historical park; and</text></paragraph><paragraph id="HA4074BA2F5CB45438DD1E2A2025C0C7D"><enum>(2)</enum><text>to identify, interpret, and provide assistance for the preservation of non-Federal land within the boundaries of the historical park and at sites in close proximity to the historical park, but located outside the boundaries of the historical park, including providing for placement of directional and interpretive signage, exhibits, and technology-based interpretive devices<deleted-phrase reported-display-style="strikethrough">; and</deleted-phrase><added-phrase reported-display-style="italic">, if the cooperative agreement provides for reasonable public access.</added-phrase></text></paragraph></section><section commented="no" id="HBE975DFE132D48718EF50777972DA5F8"><enum>7.</enum><header>Use of funds</header><text display-inline="no-display-inline"> The Secretary may use appropriated funds to mark, interpret, improve, restore, and provide technical assistance with respect to the preservation and interpretation of the properties. Any payment made by the Secretary under this clause shall be subject to an agreement that the conversion, use, or disposal of the project for purposes that are inconsistent with the purposes of this subsection, as determined by the Secretary, shall result in a right of the United States to reimbursement of the greater of—</text><paragraph commented="no" id="HFA6E97055B8144AAA4A637F56AB0C056"><enum>(1)</enum><text>the amount provided by the Secretary to the project; or</text></paragraph><paragraph commented="no" id="HCF6D7BF05AB94407BBA8FE13CA0E98CC"><enum>(2)</enum><text>an amount equal to the increase in the value of the project that is attributable to the funds, as determined by the Secretary at the time of the conversion, use, or disposal. Any cooperative agreement entered into under this subparagraph shall provide for reasonable public access to the resources covered by the cooperative agreement.</text></paragraph></section><section id="H4038BB8F9F894052885E1F8CAA8878CD"><enum>8.</enum><header>Acquisition of land</header><text display-inline="no-display-inline">The Secretary may acquire for inclusion in the historical park any land (including interests in land), buildings, or structures owned by the State, or any other political, private, or nonprofit entity by donation, transfer, exchange, or purchase from a willing seller.</text></section><section id="H76D3FEF56EE04398A5B48491EB64E548"><enum>9.</enum><header>Management plan</header><text display-inline="no-display-inline">Not later than 3 fiscal years after the date on which funds are first made available to carry out this Act, the Secretary shall complete a <deleted-phrase reported-display-style="strikethrough">general</deleted-phrase> management plan for the historical park.</text></section></legis-body><endorsement><action-date>September 27, 2022</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
