<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 144</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To authorize the Secretary of Health and Human Services, acting through the Director of the Indian Health Service, to acquire private land to facilitate access to the Desert Sage Youth Wellness Center in Hemet, California, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4773FC1AF07740709A7A76B25BE29017"><section id="idE90A452C0C6A436C8830327CAC2D8858" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Desert Sage Youth Wellness Center Access Improvement Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id17CA6D44FE3441158B565C249D9F9C2A" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Access road for Desert Sage Youth Wellness Center</header><subsection id="H81F05A2473D54EDE80CC50CB97D8457D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Acquisition of Land</header><paragraph id="H104D3D1E1ADE4CA7A5FBB4901CD9D8AC" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Indian Health Service, is authorized to acquire, from willing sellers, the land in Hemet, California, upon which is located a dirt road known as <quote>Best Road</quote>, beginning at the driveway of the Desert Sage Youth Wellness Center at Faure Road and extending to the junction of Best Road and Sage Road.</text></paragraph><paragraph id="HED2D9B5E481B4E308AE2478F86EF4B6C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">The Secretary shall pay fair market value for the land authorized to be acquired under paragraph (1). Fair market value shall be determined—</text><subparagraph id="H820A21CE0F8346159A68A6D9C138AF52" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">using Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="H92F394D645D742B186130ADF9906294A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by an appraiser acceptable to the Secretary and the owners of the land to be acquired.</text></subparagraph></paragraph><paragraph commented="no" id="HC69FE9A9916648B4A2D02691B727482A" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Additional rights</header><text display-inline="yes-display-inline">In addition to the land referred to in paragraph (1), the Secretary is authorized to acquire, from willing sellers, land or interests in land as reasonably necessary to construct and maintain the road as required by subsection (b).</text></paragraph></subsection><subsection id="H80508BD760D74D9FA8B6E0F951BE3B70" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Construction and maintenance of road</header><paragraph id="HE5058415F73F4773A11B16EE1058E19D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">After the Secretary acquires the land pursuant to subsection (a), the Secretary shall construct on that land a paved road that is generally located over Best Road to facilitate access to the Desert Sage Youth Wellness Center in Hemet, California.</text></paragraph><paragraph id="HF43A5500C0424DEEBA1DEE3D9A871842" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Maintenance</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="H72367DE3B4F944FAA5539777657470AA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">maintain and manage the road constructed pursuant to paragraph (1); or</text></subparagraph><subparagraph id="H57794CECD83741F09962915806EF5A18" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">enter into an agreement with Riverside County, California, to own, maintain and manage the road constructed pursuant to paragraph (1).</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill> |
