<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1008</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230328">March 28, 2023</action-date><action-desc><sponsor name-id="S331">Mrs. Gillibrand</sponsor> (for herself and <cosponsor name-id="S270">Mr. Schumer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Consumer Product Safety Commission to promulgate a consumer product safety standard with respect to rechargeable lithium-ion batteries used in micromobility devices, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE1F92B5ABBE04B938D4914BEE3333C4B"><section section-type="section-one" id="HE5BC91D9962D47F7ACE14005A1BA94BB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Setting Consumer Standards for Lithium-Ion Batteries Act</short-title></quote>. </text></section><section id="H1A2DD960958842FDA1E0A1575ACE9C08"><enum>2.</enum><header>Consumer product safety standard for certain batteries</header><subsection id="HF740125407FE4804974FCDCB90810146"><enum>(a)</enum><header>Consumer product safety standard required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Consumer Product Safety Commission shall promulgate, under section 553 of title 5, United States Code, a final consumer product safety standard for rechargeable lithium-ion batteries used in micromobility devices within the jurisdiction of the Commission, including electric bicycles and electric scooters, to protect against the risk of fires caused by such batteries.</text></subsection><subsection id="H251904E3D6E14DED82337DFC6EF32557"><enum>(b)</enum><header>CPSC determination of scope</header><text display-inline="yes-display-inline">The Consumer Product Safety Commission shall specify the types of rechargeable lithium-ion batteries and the types of micromobility devices within the jurisdiction of the Commission that are within the scope of subsection (a) as part of a standard promulgated under this section, as reasonably necessary to protect against the risk of fires caused by rechargeable lithium-ion batteries in consumer products.</text></subsection><subsection id="H396BF256568F43428AEBD47A5EE30C1C"><enum>(c)</enum><header>Treatment of standard</header><text display-inline="yes-display-inline">A consumer product safety standard promulgated under subsection (a) shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text></subsection></section></legis-body></bill>
