which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to initiate hearings to review Federal milk marketing orders relating to pricing of Class I skim milk, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id0CA1538F633F4286B3B184B9164B52F5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dairy Pricing Opportunity Act of 2023</short-title></quote>.</text></section><section commented="no" section-type="subsequent-section" id="idF69C1A920ABC4AAD84F63F3A28186734"><enum>2.</enum><header>Notice and hearings</header><subsection commented="no" id="id75F8310A83E344609EBE0D4F02960FC8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall provide notice of, and initiate, national hearings to review Federal milk marketing orders under section 8c(3) of the Agricultural Adjustment Act (<external-xref legal-doc="usc" parsable-cite="usc/7/608c">7 U.S.C. 608c(3)</external-xref>), reenacted with amendments by the Agricultural Marketing Agreement Act of 1937, which shall include review and consideration of views and proposals of producers and the dairy industry on the Class I skim milk price, including the <quote>higher of</quote> Class I skim milk formula described in subsection (b) and any other views and proposals on the Class I skim milk price, and such other matters as the Secretary of Agriculture considers appropriate.</text></subsection><subsection commented="no" id="idE02DF389504E4F25998B6FA8683ABCDF"><enum>(b)</enum><header><quote>Higher of</quote> Class I skim milk formula described</header><text>The <quote>higher of</quote> Class I skim milk formula referred to in subsection (a) is the formula under which, for purposes of determining prices for milk of the highest use classification, the Class I skim milk price per hundredweight specified in section 1000.50(b) of title 7, Code of Federal Regulations (or successor regulations), is equal to the sum obtained by adding—</text><paragraph commented="no" id="id9162C9D2FBD941ADB92C68FD23400BD0"><enum>(1)</enum><text>the adjusted Class I differential specified in section 1000.52 of that title (or successor regulations);</text></paragraph><paragraph commented="no" id="id6DECDE30909A4A2AA7D17513FD180243"><enum>(2)</enum><text>the adjustment to Class I prices specified in sections 1005.51(b), 1006.51(b), and 1007.51(b) of that title (or successor regulations); and</text></paragraph><paragraph commented="no" id="id019721C26C404F83B15E7E89022793FB"><enum>(3)</enum><text>the higher of—</text><subparagraph commented="no" id="id91BBCD80579F45648E9998170157C4DB"><enum>(A)</enum><text>the advanced pricing factor computed under section 1000.50(q)(1) of that title (or successor regulations); and</text></subparagraph><subparagraph commented="no" id="idD2ABA189EF654D82B7E8BCBE1F8C947F"><enum>(B)</enum><text>the advanced pricing factor computed under section 1000.50(q)(2) of that title (or successor regulations).</text></subparagraph></paragraph></subsection></section><section id="id3934ba2d173c492fbc89400a9dbf1c24"><enum>3.</enum><header>Mandatory reporting of dairy product processing costs</header><text display-inline="no-display-inline">Section 273 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1637b">7 U.S.C. 1637b</external-xref>) is amended—</text><paragraph id="idbbea804cd07440099ac8cec4152d5ae6"><enum>(1)</enum><text>in subsection (b)(1)—</text><subparagraph id="id92db3c3d5f23452180083b0a3fff6da6"><enum>(A)</enum><text>in subparagraph (A)(ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idffd5c8d775bf4737a5529ce6a04079ca"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id975b337b7d214afd942493672e928697"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id20A86F8FE7D948E8AD74E4BBF1DE62CA"><subparagraph id="idbb82cd7806cf48fdb2460f4cac4184ce"><enum>(C)</enum><text>for each manufacturer required to report under subparagraph (A) for any product, require that manufacturer to report cost and yield information, as determined by the Secretary, for all products processed in the same facility or facilities; and</text></subparagraph><subparagraph id="id5c4845f1ab7a48658c47d3ebdb634d1e"><enum>(D)</enum><text>require any manufacturer of such other dairy products as determined by the Secretary to report cost and yield information in the same manner as under subparagraph (C), for the purposes of providing information for the regulatory or administrative establishment of pricing rules.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id566e5fc4bb7045078ecf75e89f37ebe1"><enum>(2)</enum><text>in subsection (d), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb090a6bf15ed44d7ab52fa86f3899545"><paragraph id="idf689f24079a1473dbfb408d14db3e945"><enum>(3)</enum><header>Dairy product processing costs</header><text>Not later than 2 years after the date of enactment of this paragraph, and every 2 years thereafter, the Secretary shall publish a report containing the information obtained under subparagraphs (C) and (D) of subsection (b)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
